Paypal claim, £158 down bc of FAKE GOODS & I'm the BUYER!

Hi there - I'm hoping someone can shed some light on my annoying Paypal claim situation...I recently bought an item on Ebay for £158, recv'd it & saw that it was counterfeit. I started a dispute, then a claim based on it being "significantly not as described." I returned the item via 2nd class recorded delivery on the 8th Feb. I added the tracking info to Paypal's site...kept tracking it myself via Royal Mail site..but it just says that it's being progressed through their delivery system!? Friday (19th) Feb, I had an email from Paypal saying "The tracking information you provided was invalid, and we were unable to
confirm delivery of the item associated with this claim. As a result, the
case is now considered closed and we are unable to process a refund. " WHATT??!! I have an Ebay rating of 300 (100% positive) & she has a rating of 3...I read somewhere that Paypal don't take Ebay ratings into account - but they are OWNED by Ebay - surely it makes sense!?
Also, as the seller had a rating of 3, she wasn't able get my money right away...does this mean she she now has my money?
I'm guessing the package was lost by RM & I have to ring them on Mon am to find out where it is (I know, good luck!) but as I posted it in a hurry I didn't look into the insurance side of Recorded delivery options for a 2nd class parcel...does this mean I'm only able to get the max £39 refund? What are my options?
Any advice would be grately appreciated!:)

Basically you lost the paypal claim because you could not provide proof the seller received the item back, plain and simple, feedback rating has nothing to do with it on that side of things (imagine the feeback reveresed and you lost a claim because you hadn't been using ebay long, would that be fair? in short no!)
As for the claim with Royal Mail, best of luck, but you are likely to get nothing (according to their t&c) because you failed to send it via the correct service.
For future reference if you think an item is fake, gather proof it is fake then claim via paypal, you don't need to send the item back and you should (this is paypal after all) get a refund. But remember to get proof before making a claim as you only have 10 days after making the claim to prove it is a fake, whereas you get 45 days to make a claim (basic maths, you have 44 days to get proof rather than the limited 10 after making a claim and then you can raise a dispute on day 44 or 45 if I am not mistaken)

Yep the max you can claim would be the £39, Why did you send a high value item via that method for?
Sending items via recorded signed for do not always get signed by the receipient but by the post man, i get signed for items just handed to me most of the time so i guess the postman must be signing the slip or something.
It can also take a week or so for the online tracking to update to show delivery, your best bet is to contact RM and find out what is what.0 -

I sent it in a hurry - I know, I know!:mad: I was annoyed, frustrated, etc & I had a few other items to post from stuff I sold on Ebay & I tend to use 2nd class recorded for my stuff plus I didn't want to be more out of pocket. I *SHOULD* have insured it, but I didn't.:(
It's been about 15 days from posting it to today..I'll see what they say tomorrow..

well its a longshot but sending fakes goods via RM is illegal
so get back on the phone to paypal and remind them you dont have to return fake goods
problem you have is if they require proof they are fake then you are screwed

I'll talk to Paypal tomorrow & see what they say about that - it's worth a shot, right? What annoys me is how Paypal don't seem to help the claimer - I did exacly as they asked, posted it via a trackable method, which I did! They need to clarify this area & explain the options...it's better for them as a company, it would save people like me from ringing them & wasting their staff's time - and I'm sure I'm not the only one who has had this problem.0 -

If you can get Royal mail to send you this information on their headed paper upload it on to paypal and you will get your refund. Best of luck.0

Custardy the information proves that the buyer did send the parcel, therefore the tracking information is valid. Therefore they have to refund to the buyer.
This is what happened in my case and i was refunded in full.0
