but what i didn't no was one of the witness's saw the guys phone in his dash where his speedo is, possibly on the phone?
So, in other words he was complying with the law by not holding the handset but using hands free.i don't no all i no is the guy has had 2 other accidents the same as this one bit strange i think.
its not "no", its "know".it was a big collision for my car as mine is older and smaller then his and he hit my car and sent me backwards
The damage doesnt suggest a big collision. It just looks like a damaged bumper. Uncomfortable perhaps when it happened and a bit of a shock at the time but the pictures don't suggest much.yes my child has got to see a councillor as he is having night terrors and panicking when in a car.
Is the child perhaps picking up on you overstating the impact of the accident?my car is a r reg escort he was driving a audi a6 (alot bigger than mine!)
Its not a lot bigger and that doesnt matter in the slightest.

I am afraid you cannot make assumptions he was using his phone just because it was on the dash I usually put my mobile on my dash as there is a convenient place for it there, however I switch it off when in the car by myself so I cannot be distracted.
How do you know he has had two other similar accidents?0 -
i took my child to the doctors the next day, he was taken away at the scene in order to prevent anymore trauma, i do not talk about the accident infront of my child so it doesn't upset him, he has been reffered to the councillor by the doctor as she was not happy with the answers he gave to her questions and the fact that he is having nightmares, an audi a6 estate is a hell of alot bigger than my car and it was his wheel arch trim that messed my car up and it might not look like a big bang to you but it is to me as my car is my pride and joy i don't spend the money and make it look good for some idiot to mess it up i take alot of pride in my car and pay a fortune to keep it on the road legally, as for the phone business i am not saying he was on the phone im saying its a possibility as he was extremely apologetic,(there was no hands free kit in sight).
i no he has had other accidents the same as this as he was bragging about them at the scene along with the fact that he had overturned a lorry. o and as for my spelling.....am i in an english class? no, so what has that got to do with anything?0 -

In that case you should not pull out of a minor road in front of someone that has the right of way, whether he was signalling or not is irrelevant he was on the major road and you should have waited until your were sure the way was clear before emerging.0 -
Can you clarify what it is that you now want?
My understanding is that you have had cash for your car.
You child is also getting treatment (under the NHS?)
So if you are receiving healthcare and car repairs, then what is it that you are after?
BTW - It's not a trick or "smart" question (sometimes things get misunderstood in balck and white).
I'm just trying to understand what it is you think you should be entitled to that you aren't getting.0
