    I'd say speak to the mortgage company. My own experience of someone dying with an outstanding mortgage and no life insurance was that the mortgage company firstly asked how the (existing) mortgage would be settled. When they learned that another mortgage would be required to pay off the existing mortgage, they were very helpful and waived early redemption fees so long as the new mortgage was with themselves. They also offered to suspend payments for up to 6 months during the probate process, although that wasn't taken up due to the interest it would rack up.

    In a previous post you claim to be the executor and settled the estate.

    Have you talked to them(solicitor) about the house?

    How can you have done this?

    There is stlll a mortgage in your fathers name.
    The house has not been transfered to the new owners.

    Have you gone through probate yet?

    I wonder what else you may have missed.

    Problem is you don't give any much info on the estate except there is a mortgage and a house.

    Did the will detail how the mortgage should be paid from the rest of the estate?

    If not paid from the estate then there is a potential problem.

    like i said before, you don't seem to get the big picture of the info that i gave. yes me and my sisters are paying the mortgage from the start for mum & dad. but now he's not here, and mother needs to stay there!

    I understand that the current payments are being made, but as I understand it the mortgage needs repaying in FULL as part of settleing the estate and getting through probate so you can inherit the house?

    How are you going to do that?

    Dont think you can just do that there is a mortgage the estate needs to pay the debt(mortgage)
