Taking Photos: How to Prove Date??

What is the legal way to prove the date photos were taken of a room?

Independant witness?
Police?
Date on a newspaper?

Cant get landlord to sign off the pictures, he is on holiday.

  • Impartial witness would be best. Don't you have a digital camera with a date-stamp?

    yes would that be ok? The timestamp i mean?

    Also would the witness have to sign anything or be in shot or something?

    What do you want the photos for? A newspaper proves the photos were taken on or after a particular date (e.g. checkout on last day), they don't prove on or before a given date.

    I am leaving a property and the landlord wont be with me to inspect the property when i move out so i need a way to prove the room was how i left it.

    He is that kinda guy that would use any reason to charge me extra. As i said in a previous thread, his response to my deposit return request was "what deposit?"

    Thats why i need this to be 100% right so im covered if it goes to court, which im sure it will as he is an !!!!!!!.

    Is your deposit in a protected if not. I would just phone him and tell you want your full deposit back regardless of damage the landlord feels you've done other wise you'll go to small claims court for three times the amount should soon shut him up.

    On the other front send him a copy by recorded delivery that will be dated and accepted as proof. and the other poster susgestions
  • Best thing is use a witness. Someone with some standing, a school headmisstress or parish priest etc. You could use a solicitor but they would charge you an outragious fee for sucha task
  • Didgitel Pictures with the date cannot be used as evidence as the date can be altered.

    All the proof you would have from this is that you sent some sort of recorded delivery package.

    Having a photograph would only show that the room was at some time in the state suggested - and not whether there were or were not any ripped material at the back of a chair, scratches on a table top, etc.

    Using a newspaper with the date of departure would show that the room was at some time that day (end of previous day - depends where you live) in a broadly acceptable state.

    Handing over keys to an independent person and getting a timed result could help too.

    There will be a flaw in every plan...

    Take the memory card/film and post it TO YOURSELF by special delivery, then don't open it - oldest copyright proof method in the book and accepted in law.

    As for a newspaper only showing the room was good for part of the day, that is true but a small claims court would still take those photos as reasonable evidence of the state in which the place was left. Depending on when you can leave, get an evening paper to show it was that way after say 5 or 6pm?

    Take photos of EVERYTHING - backs of sofas etc included. The landlord is less likely to be belived if they later claim that you spent 90 minutes taking 500 photos of the house JUST to the cause damage afterwards!

    A signed statement from an independant witness who is willing to stake their job will be enough for most people also.

    If you have a camcorder, take shots of the house and keep it rolling as you leave, lock up and hand back keys. The only argument against THAT would be that you had spare keys cut and let yourselves back in - that's a big allegation and wouldn't be made lightly!

    Anyways, consipiracies left aside - good luck! ;)

    I think ill go with the newspaper one + date stamp on photo coupled with a recorded delivery letter that i am leaving the property that day and the keys are enclosed.
