coolio wrote:And in the meantime your card is cloned, and someone goes on a jolly. Things like this aren't covered out of thin air and credit card companies will revoke other offers to cover such costs to themselves. I think you should take some responsibility
They have had enough from me in terms of interest etc over the last 7-8 years. Thats why I use them - cover they provide. If it goes wrong then I will sort it via that protection method...0 -
I like there terms and conditions here
Limitation Of Liability And Warranty
CUSTOMER AGREES THAT USE OF THE SERVICE IS ENTIRELY AT CUSTOMER'S OWN RISK. SERVICES ARE PROVIDED 'AS IS,' WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY FOR INFORMATION, SERVICES, UNINTERRUPTED ACCESS, OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THE SERVICE, INCLUDING WITHOUT LIMITATION THE SOFTWARE LICENSED TO THE CUSTOMER AND THE RESULTS OBTAINED THROUGH THE SERVICE. SPECIFICALLY, WE DISCLAIM ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION: 1) ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY OR CONTENT OF INFORMATION, PRODUCTS OR SERVICES; AND 2) ANY WARRANTIES OF TITLE OR WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
I would avoid this company with a 50ft bargepole

So, the ipod doesnt come with any warranty?!
And the software downloaded is dodgy. Good Luck Papa L as downloading spyware and having your credit card cloned through that iirc, isn't recoverable through your credit card company.0 -
I think they are breaking the law.
Unfair contracts and the sales of goods act doesnt even apply to them. DTI where are you?
I think Op should remove those links I hate someone to get stung.
From sales of goods act HERE "It is the seller, not the manufacturer, who is responsible if goods do not conform to contract."
From there terms and conditions "CUSTOMER AGREES THAT USE OF THE SERVICE IS ENTIRELY AT CUSTOMER'S OWN RISK. SERVICES ARE PROVIDED 'AS IS,' WITHOUT WARRANTY OF ANY KIND"
Also unfair contracts, ie there terms and conditions HERE
"The Unfair Contract Terms Act 1977 limits the use of exclusion clauses in contracts. Generally only a court can decide whether an exclusion clause is reasonable, However, any exclusion of liability whether in a contract term or in a notice is always void if used for the purpose of evading liability for death or personal injury caused by negligence. Also, a trader selling goods cannot exclude liability for a breach of a consumer’s rights under the Sale of Goods Act.
Contractual exclusion clauses in relation to services are not illegal but they are not enforceable if they are unreasonable."

Look Coolio (you use thedvdforums right?) thanks for the concern. If there is any problems, i'll have learnt a lesson. If they lift my details via their website i'm covered. I won't lose money on it. If it works, i'll have a cheap Nano...
Should I post back or not based on my experience of them?0 -
Why does it matter what other forums I use?
I don't see how you are covered with the software download. I just don't understand why people go in for things like this when it's dodgier than my mums French.0 -
It doesn't matter one jot which forums you use
. Just thought I recognised you (I post under a different name there).
FWIW, having scanned my PC, checked it with Adaware, using Spyware blaster etc, I haven't received anything from them in terms of spyware. If details are taken when ordering via the internet, it is covered (as says my CCs t&c's).
I don't want to argue, so lets agree to disagree shall we?

No I think I will - did you spot the T&C clause about not warranting title to the goods? i.e. we may not even own the stuff we are selling you and we aren't going to back you up if it all turns pear shaped!altho i must have the last word
I would hate to think what getting a refund out of this lot will be like. You don't get medals for sitting in the trenches.0
