The OP has lost her SDP she will not lose anymore.
The daughter could claim CA which is £53.10 which then gives the daughter an underlying entitlement to a carers premium of £29.50.

The benefits of the person you care for

If you claim Carer's Allowance, it could affect the amount of benefit the person you care for receives.
The person you care for could lose the severe disability premium in their income-related benefit or the addition for severe disability in their Pension Credit. If you only have an underlying entitlement to Carer's Allowance and are not actually paid it, this will not affect the benefits of the person you care for.

Informing the person you care for that you are making a claim

Because your claim for Carer's Allowance may affect the benefits of the person you are caring for, they need to write down on your claim form that:
    • they know you are claiming Carer's Allowance
    • you are caring for them for at least 35 hours a week

You don't get the Carers allowance and the Carers premium you only get the smaller premium when on IS and the full amount of Carers if you are not. Carers is a taxable income so you do effectivly loose some of it by having only the lower premium for being on IS.

Also to the OP if your daughter claims Carers it will again be her money not yours and so can not be claimed just to make up for your loosing the SD premium it should be hers to spend as she wishes for all the help she gives you. It's to make her life easier for being a carer not for topping up your total benefits.

I think you are missing the point totally! If the OP was to claim CA yes she would only get the carers premium as they would deduct £53.10 from her IS but we aren't talking about the OP we are talking about her daughter claiming CA. Two seperate people, two seperate claims.

Again the OP will not lose any further benefits if her daughter claims CA.

  • Daughter would still be in a difficult position to claim CA.

Although the Learning and Skills Council, and the Direct.Gov website refer to 21 hours of supervised study, many colleges are running full time courses which are just 2 days at college.
I wouldn't like to be the one arguing that a full time education course at 14 hours, is not full time as it's less than 21 hours.
Plus, you would still be receiving CTC and CB for your daughter, if she was in full time college, so you can't really conceal the fact she is in education.

Even of the GF pays rent, it would be counted as income somewhere along the way.

  • When I was at university (and this is recently, I only graduated a few months ago), the part time course was four hours a week and the full time course was eight hours a week - that's the time in class and lectures. There was, of course, plenty of study outside of those hours!

My point is that the full time course, although only eight hours in university, was classed as full time study and I could not claim CA had I wanted to complete my studies in three years (full time) instead of five (part time). If the prospectus says full time, you cannot claim CA. That is what I was told by the CA unit in Preston.
  • Does anyone actually believe that the daughter is actually caring for her?

Seems like abuse of the benefit, to me.

    They are (they're)
    sitting on the floor.
    Their
books are lying on the floor.
The books are sitting just there on the floor.
