As long as she cares for you for at least 35 hrs a week.

    Who cannot get Carer's Allowance

    Education

You cannot get Carer's Allowance if you are on a course of full-time education or you are on holiday from a course of full-time education.
Full-time education means 21 hours or more of supervised study each week undertaken through a school, college, university or similar educational establishment. This includes time spent on related exercises, experiments, projects or examinations.

    Work and earnings

You cannot get Carer's Allowance if you earn more than £95 a week after money has been taken off to allow for your expenses.
Expenses that are allowed are for things like:
    • some National Insurance (NI) contributions
    • Income Tax
    • half of any money you pay towards personal or occupational pension schemes
    • other expenses you have to pay because they are a necessary part of your job

After allowing for these things, you are allowed up to half the rest of the money you earn to help meet the cost of paying someone else (but not a close relative) to look after a child or children, or the person you look after, while you are at work.

Residing or remaining in the UK

You cannot get Carer's Allowance if your right to reside or remain in the United Kingdom is subject to limitation or restriction by the Home Office.

  • i was asking this question a few months ago but decided against it as claiming tax credits as in full time education may of interfered with the carers allowance . as he does 2 and a half days at college but was gonna claim carers allowance for looking after his brother.
  • If she does though then you will loose an amount from your income support and the money she gets from Carers will be hers not yours.

Does she care for you for that amount of time per week?

You can't just try and work things to keep the same amount of money you're used to, Carers allowance is only aplicable if she is caring for you.

My partner claims carers for caring for me when he is out of work (company he worked for went bust), he does help me a great deal and I find it very hard to go outdoors by myself. When he is working my Mum comes over often and she runs me around and helps me take my girls out (though she's becoming less able to do so due to I'll health) she doesn't claim Carers for me because financialy she can't.

Does that equal 35 hours per week? It doesn't say anywhere you have to be caring for someone on a certain day for a certain amount of hours.

Really?! Exactly what amount would the OP loose from her IS?

Maybe a silly question, but it doesn't say in your post - what disability benefit you're getting after you lost your severe disability premium - are you still getting the qualifying rate of DLA or other benefit that still allows a claim to CA?

I think the way they do it is to give you a Carers premium instead of full Carers allowance which is less than the amount of Carers you would get if you were not claiming income support. I have been in this situation but I can't remember how much it was.

And to the OP if she only cares for you at the weekends and only in the day then I'd guess this will be more like 28 hours maybe?

If she's in school only 2 days a week but only cares for you on the weekend then where's her other 3 days a week gone?

I'm getting somewhat confused by this now especialy since there is now simple higher rate DLA it is awarded in two parts there are two levels for mobility and 3 for care.

Maybe if you briefly said what your dissability was then it might help us understand?

The OP has lost her SDP she will not lose anymore.
The daughter could claim CA which is £53.10 which then gives the daughter an underlying entitlement to a carers premium of £29.50.

The benefits of the person you care for

If you claim Carer's Allowance, it could affect the amount of benefit the person you care for receives.
The person you care for could lose the severe disability premium in their income-related benefit or the addition for severe disability in their Pension Credit. If you only have an underlying entitlement to Carer's Allowance and are not actually paid it, this will not affect the benefits of the person you care for.

Informing the person you care for that you are making a claim

Because your claim for Carer's Allowance may affect the benefits of the person you are caring for, they need to write down on your claim form that:
    • they know you are claiming Carer's Allowance
    • you are caring for them for at least 35 hours a week
