  • thanks for that been deleting stuff off it all day lol. anyway that is what they sent me with two lots of terms and conditions exactly the same but look like they have been printed off any computer. Thay are not on any letter heard so cannot say if they came from capital one or not.

    So is it a cca or not

    It does not contain any of the prescribed terms.

    As fermi saod, they may be in the T&Cs?

    However, could you check the T&Cs and find out what the penalty charge is? if it is £12, then they are dodgy.

  • have read and read and read the terms and conditions and nowhere does it mention the cost of a penalty clause.

    In Other charges and default charges it talks about overlimit charges and late payment charges etc but does not state how much these are just then goes on about you must pay to us all reasonable court costs.......

    How much are these charges set at?

  • it says all charges may be varied as set out in section 18. Section 18 is titled variation and goes on about how they can change the terms of the agreement and if there is a change of the base rate where interest is linked to base rate. But does not state an amount of the charges anywhere
  • also in section 12 other charges it says :

    You must pay to us the "Other Charges and Default Charges" referred to in the Key Information (as varied from time to time) and in our tariff of charges from time to time in force etc etc

    But i have not got "Key Information" and it was not included in the paperwork they sent me
  • does anyone know if this is a legal cca or not???????
  • and if it is not legal what do i do about the stat demand please
