I really dont know enough to comment... But if she isnt working and housing benefit are paying her rent, she isnt gaining from the discounted rent, housing benefit are.

As the case hasn't started yet, what has happened up to now is irrelevant - they can't go back to before the date she applied anyway. You aren't renewing the tenancy so it really isn't that long a period.0

I'd suggest you get some advice from the nice chaps and chapesses on the House Buying, Renting and Letting forum on how to go about giving her notice etc. In effect your husband will potentially be evicting his young son so the situation could get more than a tad nasty.Eat food.
