HELP csa nightmare

Please can anyone advise me?
my husband and i rent a house to my husbands sons mother, the reason i say it that way is coz she is hardly an ex they were never really together about a month if that! 7 month later she come back saying she was pregnant!! anyway he has always paid and seen his son, after a few years we rented her a house so his son was closer to us, we saw him alot then he stopped coming and after 2 years she has gone to the csa .we always paid her directly up until she rented the house then we gave her low rent in leiu of maintenance, she has told the csa this is not the case and we are now having to pay csa as well as let her have low rent, we cant up her rent to what it should be and the csa are taking her word over ours even though we have sent evidence but not proof as we dont have it writing it was a verbal agreement between ourselves. I am sure this must be fraud??? we cant afford to pay 2 lots of maintenance we have 2 kids and another on the way. Please help what can we do????

Does she have a tenancy agreement? Is the rent significantly lower than the market rate?0

yes she has a contract, we wanted and could of got off another person £625pm we give her £140pm so her rent is £525, which we put on contract, but we should of put the £625 and deducted maintenance but because of who she was we thought it didn't matter. Silly us0 -

In that case you will not be in a position to increase the rent until the fixed period has expired - Is there long left?
Will you renew with another short hold tenancy agreement at the end of the fixed period OR allow the agreement to become a Statutory periodic tenancy, which is not fixed term and would run from month to month?A fairer CSA for all0 -
It runs out end of june, not going to renew tennancy she has caused nothing but trouble.0

The CSA cannot take reduced rent as being in lieu of maintenance - except for a period where they are working out what payments should be, ie when they have calculated it will be the full amount from thenonin, but prior to that you have to request that the reduced rent is counted.0

according to there website they do if the nrp pays rent or mortgage on a house there child lives in it counts we fall short on that mortgage everymonth and have to put towards,

A variation can be applied for with regard to payments made by the NRP on a mortgage for a home they shared with the PWC.
The PWC and child/ren must still live there and the NRP must not have a legal interest in it.
The agency don't usually accept payments made to a third party eg mortgage lender, as CM payments.
Such payments may be considered as voluntary payments when made in the period between the effective date and the calculation date, and offset against any initial arrears.

thankyou, i just dont get it! how she can lie fraudulently claim she isn't getting anything from us, the csa take her word for it and we end up out of pocket in effect she is getting £250pm out of us for 1 child, I get less than that for 2, how is this right?? we both work hard barely get by on what we earn to have to give it all to her while she sits on her backside doing nowt!!!!
Just shows that spitting kids out for the sake of it works0
