I have noticed a recurring pattern in your posts which basically involves suggesting employees to commit fraud, lie and act unethically to get round employment law.

There is nothing discriminatory here so they can get rid if they want. If the OP thinks its a good idea she could raise a grievance and speed up her exit.

Otherwise I suggest they get their head down, work hard and ensure they are being productive.

Retail stores expect a lot for not a lot. That is life. I am going to hazard a guess at the moment the store is underperforming because the staff spend more time having a laugh with each other than they do working.

And employers would never dream of committing such a heinous crime would they?

    What a load of rubbish.

As I alluded to in my post and proved to be correct, you have jumped in with both feet and once again you are wrong.

There are many reasons that dismissals are deemed 'automatically unfair'.

Had you taken more time to click on the link rather that shoot from the hips, the business link page quite clearly defines what constitutes as automatic unfair dismissal, and they cannot just "get rid of who they want".

As for me suggesting fraud and being unethical, please enlighten me - tell me in ANY of my postings that suggests fraud - hopefully you can substantiate those libellous accusations - they will be reported as abuse BTW - like many of your posts.

I was merely suggesting that the OP had the opportunity to cite health & safety issues as a potential way to exit the company - legitimately - I also indicated that as there are undoubtedly safety issues ongoing - that cannot be disputed - should the OP be sacked for raising or taking action on those issues, THAT COULD POTENTIALLY BE DEEMED AS AN AUTOMATIC UNFAIR DISMISSAL.

Are you suggesting it is OK for the staff at the OP's workplace to work in a manner that may compromise their safety? Although, I think I will know your answer to that one!

If you also took time to digest my post fully, I did state that's how I would handle the situation.

I am not attempting to get around employment law as you accuse - it would seem that the only party attempting this is the company involved - and their ethics certainly are questionable.

I am merely citing potential breaches of Health & Safety Law and I suggested that the OP addresses this issue with the company health & safety representative.

I have based my post on the limited information posted - you (as always) have assumed far too much.
I am going to hazard a guess at the moment the store is underperforming because the staff spend more time having a laugh with each other than they do working

    I rest my case!

And as for YOU - (the person it seems whose sole purpose in life is to trawl these forums to offend, insult and bully any unfortunate soul seeking assistance, help or advice) taking the moral high ground accusing ME of inciting people to lie and act unethical - ........ pick me up off the floor before I wet myself.:rotfl::rotfl::rotfl::rotfl:

    Wow - Ivrytwr3 I hope I don't upset you then.

I could go into a story about genitalia and cups of tea in the workplace, but there may be some people drinking their coffee while reading this thread.

    Quite funny though. :)

Surely your HR department will want to know why there have been so many sackings going on?? Or perhaps they are not aware of them? Perhaps this manager is reporting to her superiors/HR that these people are leaving of their own accord, given that no written reasons for dismissal appear to have been provided to them.

it could definately be this, bear in mind we don't know how successful the branch is, is it making money, does it have to many staff, are they performing to company standards etc etc etc

Am I right in thinking that Tescos say 20 minutes per frozen cage?

  • Thanks again everyone for your replies :) I think I will get in touch with the HR department about my concerns, even if what she's doing isn't technically wrong, she is still breaching our contracts and breaking rules with the way she is letting people go.

Anihilator - it's quite possible that our store is under-performing, and this is why she's been brought in- to try and improve our productivity. It's just the way which she's going about it which is the problem, like I said, even if sacking practically the entire workforce is her way of getting us to work harder, she's breaching our contracts by doing so on the spot.

'Otherwise I suggest they get their head down, work hard and ensure they are being productive.'

I assure you that's what we're doing :) I'm still getting the feeling that it may not be good enough though!

Dpassmore - thanks for the links, I'll just read them now :)
  • 'for exercising or seeking to exercise their right to be accompanied at a disciplinary or grievance hearing, or to accompany a fellow worker at such a meeting'

I found this interesting from the first link, the people who were sacked were never offfered the opportunity to have anyone present with them. Although this isn't the same as asking for one and being refused, I suppose.

Are you sure that when she fires someone they are not getting paid the weeks notice they are entitled to. Sometimes when people are told to go straight away it doesn't mean that she has breached a contract, if they are paid up in full ie., one weeks notice any holiday pay they have accrued and any wages outstanding, she has adhered to company guidelines.
Also she may not have been brought in to sort anything out, when I worked in retail our Manager's changed on a regular basis, some were great some were obnoxious and thought they were God. Stick it out, she may not be there for long, she'll probably move on to another branch and reek havoc.

Well...I could write a book about the things that employers will do give them half a chance by now... I've certainly seen an awful lot of them by now....hence why if I say an employer IS being fair/ethical by now...then...yep...they really ARE.

Re "post...(being) digested fully"....this DOES tend to happen a lot on MSE. I sometimes find that people have misinterpreted/twisted what I said - and then, on investigation, see that this is something they do frequently because they WANT to "have a go" at someone/anyone and/or they have skim-read and not bothered to stop and think what I am actually really saying and seen "what they want to see" - rather than what I actually said.

+1 for a demonstration. Shouldn't be that hard to ask for. If she really is as bad as you say then play her ego and get a stop watch out...
Nothing I say represents any past, present or future employer.
  • I got the number for HR when I was at work today, apparently one of the supervisors has already spoken with them to complain, and a few of the other shop floor staff are going to do the same tonight. I'd like to ring them too but to be honest I have no idea how I'd put my complaint across (I'm one of those people who hates speaking on the phone about stuff like this, I'd much rather send an email or have a face-to-face meeting) . Any ideas about what I could say?
