New letters: If banks fail to repsond.

Hi

I applied to get charges back like many was told on hold untill court case etc.

Then Letter from banks stating not paying out etc. And giving me 8 weeks to respond.

I have since replied using the new letters, however i note there is a 14day deadline on the template.

I sent the letter off on the 4th Feb - 13 days ago. What if i receive no letter tomorrow?

What are my next steps? FOS?

    Not sure why the templates have 14 days on if martins not recommending court action as the bank does have 8 weeks - then you can go to FOS. The bank should tho respond to you within I think 5 days to confirm they are looking into it.

    Have you received a response today?

    You do normally need to give the bank 8 weeks to respond before going to the FOS, but that is from the initial raising of the complaint, not each time you respond to them. It clearly has been well in excess of 8 weeks since you raised the complaint ... and even allowing for the complication of the hold pending the decision of the SC, that decision itself was well over 8 weeks ago.

    14 days seems a reasonable timeframe in which to request a response to their refusal to consider your claim, and if one was not forthcoming, I believe you could now take the matter to the FOS which is the preferred route prior to raising a court claim if necessary.

    One area where you may need to leave the full 8 weeks again is if you have substantially revised the basis of your claim i.e. from one of a legal basis to one of financial hardship.

    If you have not introduced any element of financial hardship, then I would expect a deadlock letter from the bank which would allow you to progress immediately to the FOS.

    Thanks for this... the basis of my (14 day deadline) letters, have been to reconsider giving Martins new arguments. I have been claiming via the hardship route all along as per my original letters.

    I have yet to check the post.. but i will call my partner in a moment and check if i have any post.

    If you were always claiming based on financial hardship, you should never have agreed to the the matter being put on hold ... there was an exemption for financial hardship cases.

  • I had a partial payout with the rest pending the decision of the case.
  • Still have had no response.. it has now been 15 days.


    Any advice?

    They have 8 weeks to resolve any complaints about charges so unless it has been 8 weeks you can either (a) Contact the bank and ask
    or (b) send another 14 days letter
    or (c) do nothing until 8 weeks is up.

  • But as a poster already put... it has been well over 8 weeks since the original letter went in.

    This is still the same complaint is it not?
  • Unless I am in another time dimension, 4 february and 8 weeks time is definitely not yet here.
