    I think you need to walk a fine line between making him realise he needs to pay or get the work done ASAP and making such a fuss he cannot work so cannot pay.

    But if he has that much equity......

    I know what you mean. This will all be water off a duck's back to him at the moment. But I am going to open SUCH a can of whoopass on him...

    He picked the wrong person to stitch up this time. (Must remember to keep thinking that!)
  • Have you thought about an AE or is it OE ? Basically an aural ?/ oral examination - where you get to quiz the defendant about any assets they have - ie house, car, bank accounts, savings, etc , etc. Since the money was paid into the defendants wife's account I am not sure if you could get her in for questioning. From the result of the questioning you can decide where to attach ie maybe get the bank account frozen - etc.
    Your solicitor should be able to go through the options with you.

    Yep, an order for Questioning.... I had him in for that a few months ago. My ulterior motive was to cause him lots of inconvenience, which worked. I have quite a lot of info on him but only some bits of it are useful. Although he was under oath I believe he was a little sparing with the truth. I complained and they said a deputy had done it without having been trained! This is my life!

    It didn't affect the outcome, but shows these people are as useless as everyone else. There have been several instances where the courts messed up. Ad here's me thinking they were really important and professional! Sometimes it must work in your favour though...

    I don't know if the wife's allowed to be brought in for the same thing. I guess I could try an application and see? Interesting to see how her answers compare with her husbands.

    You know? I think I'll do that tomorrow if Trading Standards don't feel like it. Saves me getting bored.

    The thread is posted by someone called Blueback and they say they are not a Solicitor so but they are posting on behalf of the debtors rather than the creditors. Of course, if you know what the enemy are planning you can pre-emp that and strike where it hurts!

    I'm sure you'll get through the hard times, life always has ups and downs and you seem like the kind of person who can tough it out and make it through this. Just remember life is a roller coaster and it can't always be the best. But I'm sure it will improve, things always tend to work out for the best in the end.
