if you have a cinviction for fraud can you.....

need you guys and dolls to settle a debate, in my favour :D:rotfl:

i assume and believe you can't have any bank account if you have a fraud conviction, existing bank accounts closed, this is logged on credit file, and even if someone was to 'add' you to their ac, it wont happen.


silly friend thinks after 5 years you don't need to declare conviction, therefore you can get bank accoount, even mortgage:eek:

if within 5 years, ywou can be added to someone's account as a joint entry, and existing accounts will not be terminated.:mad::mad::mad:


seems all to far fetched to me considering aml


can you settle this for me, i wont my free drink at pub on friday

    5 years is the period after which a criminal conviction which is punished by fine or another lower form of punishment is considered to be spent and would no longer have to be declared.

    A quick google led me HERE which has some further information.

    I have no idea about the credit file issues and how long it would stay on there but most data is removed from the file after 6 years and I'm pretty sure its even less time for a CIFAS marker

  • If you're speaking about CRB then you still have to declare spent convictions in certain jobs, for instance the council or working with kids/vulnerable people.

    With respect to credit, it stays for 6 years in the majority of cases but not when you speak about bankruptcy or CCJ's as these can stay longer and when asked (say by an employer) if you've ever been bankrupt you have to say yes - it never becomes spent as such and can be easily found by checking statute records such as registry trust.

    wow cheers, our example for fraud was someone stealing from a company via dodgy credit cards, and what affect it would have on life in general like jobs, bank accounts credit file etc

    Criminal record has no affect on your credit file. It matters not what type of conviction you have(fraud or otherwise). So am sorry you are wrong.
    You can be a sex offender and hold a gold card!
    For everthing else there's mastercard.
    For clampers there's Barclaycard.

    Oh thats no problem, unless they got charged with an offence for say fraud, in which case it may affect certain jobs..... in the main, if there was no criminal proceedings then there would be nothing to see :D

    oh ok, I assumed we would be a lot stricter on people especially fraudsters, so I assume we limit their access to credit/mortgages etc

    i think i'm getting it now, so there is more impact on certain jobs as opposed to what credit you can obtain, esp if it is fraud, i'd expect tougher sanctions

  • Im not sure why you expect tough credit restirictions for fraudsters, surely they are more interested in OTHER peoples credit ratings anyway - "oh, ive been declined for a barclaycard, maybe if i use my neighbours details instead..."

    well i just assumed fraudster would be then blacklisted so to speak, or at least a recording on credit files so if they did try and obtain mortgage/credit, the relevant people would keep a closer eye on them.

    it was just a random discussion on a lunch break in the pub about fradusters, and not only criminal sanctions but the general impact such a conviction would have
