Getting a solicitor to write that you want to live apart for whatever reasons will not work. If you holiday together,see each other reguarly and act as a couple etc at any other times no matter where you live, you will be treated as a couple for benefit purposes.“You’re only here for a short visit.

OP it sounds like you and your partner really want to live together, so I think you should just do it. Maybe losing the benefits will give your partner the encouragement to want to get into work, which will help you both financially and help her mental health.0

TBH OP why not run the scenario by the CAB find out where you stand from the experts
The so-called experts on this board spout a load of slightly-to-the-right of Attilla the Hun Bulls**t on this forum Dont listen to a word.
I have had a man-friend for the last ten years We live in separate houses He claims no benefits where I on the other hand claim Mortgage interest payments Income support CT benefit and every other benefit know to man.
I have left him everything in my will House etc. He has left me the same He never stays the night at my house nor I at his but he comes around mine every Wednesday and Saturday to give me a right good seeing too Magic!!
Never had a penny off of him in my life Been doing this for the last God know when Never a cheep from the DWP
My advice get wills written dont bother with that civil partnership Could end up ruining a beautiful friendship

Thanks everyone for the helpful replies and warnings about what to expect from the responses lol. I can't move in with her as she has a tiny flat and I have two small children and we wouldn't all fit.
I'm not looking for a way 'around' anything, this is the situation and there's no ulterior motive. Some people seem to want to believe that anyone who claims benefits should be looked down on and considered to be criminal. I don't claim anything personally but am more than happy that my taxes will help support people who need support - perhaps people should consider the old adage 'there but for the grace of god...' blink and your whole life could change, people who need support don't deserve to be disrespected, imagine how much that internalised prejudice could damage you if you don't always have the life that you think is yours.
It seems odd to me that anyone could think that this is about convincing anyone of anything, or that curing mental illness is as simple as getting a job - we have a long way to go it seems before illness of the mind is taken seriously and people aren't just expected to pull their socks up, very sad.0 -

Strange post. Where did anyone on here suggest that people claiming benefits are criminals? Who has disrespected people that need support? Who has suggested that mental illness can be cured by getting a job?
I agree that the benefit system should support those in greatest need - but I also agree that if a couple make a commitment to each other then that commitment should include supporting each other financially. If you are unable to live together and manage on less money then yes, you will need to put the needs of your children first and remain as you are until her health improves so she can get back to work or you start earning more money. Having choice is the freedom that earning your own money gives you.0 -

Why should you be happy for your taxes to support strangers and yet be loth to support the woman you love?
Many people on here have themselves suffered (or still do) from mental illness so the disrespect and prejudice you think you see is really not there. Beiing mentally ill doesn't mean that people can't still value personal responsibility and commitment.
Surely you wouldn't want to ally yourself with someone with views like Mazzybaby's, because that's the very least you risk by following the course of action you suggest.0 -
