Caquest - Debt Collection Agency - HELP!!!!!!

I think this is the right place to put this if not sorry in advance.

This morning I got a letter from CAPQUEST saying i owe £436.79 on behalf of Natwest Bank. Now I have not banked with Natwest for about 6 years or so and did have a debt that was paid (I had a number of debts paid through the consumer credit counselling service - this been one of them) All these where paid off about 2 1/2 years ago.

I phoned CAPUEST who said I need to provide proof if I have paid it, well I dont have any as I once had confirmation saying it was paid. I asked them what the debt was for and they couldnt provide any information nor could they provide me information on natwests telephone number for me to discuss this with them (as I am sure they would be more friendly than the cow on the phone I spoke to) the lady on the phone suggested I call directy enquires, but we all know that some team in natwest head office on a number most likley not easily avaliable in the public domain.

Anyway, has anyone had CAPQUEST problems before and are they one of these companies who buy old debts that arent really debts anymore, when I said to the woman that the debt was paid by CCCS over a number of years her confidence that I did owe the money seem to slip away from the tone of her voice.

Help us please guys!:confused:

    No - the onus is on them to prove you owe - not the other way round.

    I have noticed the "account number" they say from natwest is not an account number as such but was the reference attached to account when it was dealt with the CCCS

    Not heard of this lot, but my DH has had dealings with LINK who bought his debt(of 6 years ago, before we were together) from Barclays which he thought had been written off. Link started contacting him just over a year ago, at the 5 year mark and he received a number of letters and very rude, persistant phonecalls. The debt was his but after contacting CAB he was told that in Scotland they can't demand repayment if 5 years have gone past. Apparently it's 6 in England and he tried to tell Link this but they ignored him. He asked for proof of how much he owed but they said they couldn't provide this. Anyway it was on his Experian report for a year up to the 6 year mark and now it has magically disappeared. And no more word from Link although in the last phone call they threatened to get the police involved!

    If you have actually paid this debt I wouldn't worry about it but it might mess up your credit scoring. Get a report and speak to the CAB.

    Appreciate that, but can a Debt Collection Agency add something to your credit file. I am sure if already shows as a default there so cant see what they can add as I thought a CCJ only comes from the court.

    Sounds very dubious to me, that they waited 2.5 years to ask for this apparent due amount? CCCS may be able to get you a printout of your payments to this account if there is any archived info. Also you should have got a letter around 6 months before the end of your CCCS plan to advise you to call all your creditors to check the balances as they can go up (and occasionally down) with charges+interest, which if different should then have been given to CCCS and updated. If you did that then all should be ok as the balance you paid would have been final. Above all tell them they (Capquest) need to provide proof you owe them money and until they do, dont put up with them, if they persist, refer them to trading standards. Any default you had normally stays on file 6 years.

    ....I did get a letter from CCCS saying write to and get all the updated infor from the banks etc - I did and only 2 or 3 out of 8/9 replied.

    Ahh... but MSE's favourite organisation the OFT (see all the posts about the OFT findings on bank charges) says that they think debts should be able to be chased past the 6 years which the law limits them to.

    Simply contact Natwest customer services on the normal telephone number and they will be able to check to see what has happened with the account and where the debt has come from

    Aaah good old Capquest.....had run-ins with these berks a while ago chasing a debt of my hubby's.....crooks they are!

    Lots of unsatisfied folk on there!

    Basically they reckon they are chasing up unpaid debts none of which tend to exist under (as Astaroth says) the 6 year time limit...and they harrass you to the point of madness! And then they sell this 'supposed debt' to numerous other companies who all end up chasing you for the same amount of money!

    Thankfully we saw them off good style!
