More and more clampers are now insisting on cash or claiming the card machine is broke purely because of the number of chargebacks they are hit with.
The answer, in hindsight and if you had time, is to sit in the car and say that you don't use cash for anything you use cards and you're not budging until they accept the card or let you off. You are prepared to pay.. but only with a card.
..then obviously do a chargeback.
What you need to do now is write a 'NOTICE BEFORE ACTION' letter to both the landowner and the clamping firm stating that you were illegally clamped and only paid under duress. You want the money refunding.
Ignore any 'appeals' process.. they're nonsense. Do the NBA (full advice on Peppino) and then when they reject that.. take them to the small claims court. They won't defend it and you'll get your money back.0 -
Get more than fifty percent of the residents onside and you can kick out the managment company.
Plus sue them jointly and severally as well as the clamper.0 -

I would say they should club together and get a locksmith to release all the clamps without damage to the locks or chains. Then consider legal ideas about what to do with the clamps - maybe hand them in at the Police station as lost property so the clampers have to go get them...and so that the Police can vouch for the clamps having being handed in undamaged.

Each motorist should then put permits on show (if they have them) and clear notices on their cars worded similarly to Sarah1969's suggestion, denying any implied contract to be clamped on this site.
Those of you who have paid, must take the clampers and whoever instructed them (the Managing Agents?) to the Small Claims Court. Pepipoo will advise you how to do this, they have 'been there, done that'. You WILL get your money back.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi guys,
apologies for not responding back so quickly but I have had problems getting the pictures sorted.
We had the meeting but only 2 people turned up. We could see that everyone has paid their clamping fees as all the clamps were removed.
