According to that Daily Express article, Baisden works for Parking Control Management Ltd. They seem to be a charming bunch:

It's interesting to note that, according to Companies House, Parking Control Management Ltd has been in liquidation since 2005; a related company (same directors) Parking Control Management (UK) Ltd, is under a voluntary arrangement.

There's something in common law referring to "quiet, peaceful enjoyment" of your land!

Quiet meaning lack of hassle, not noise! By entering your property without your permission they have actually trespassed...

I'll try to find said law later although I'm pretty sure there was a thread on pepipoo with similar circumstances, might be worth a search.

    Thank you guys,
I have also raised this on pepipoo website, which by the way is fantastic. There is going to be a meeting later with other affected tenants.

Would you have any advise for people that have not yet paid the fine?

    Thanks

Yes- don't pay it, support each other & blockade the clampers vehicle(s)-notify the police (breach of the peace incident) & local/national media.

Another group of residents somewhere faced a comparable situation not long ago & did exactly that. (Can't find a link to this at the moment).
The clampers released the vehicles & scuttled off with their tales between their legs.

Ok, then it depends on how much you want to force the issue?

I certainly wouldn't be paying cos although you can go through small claims to reclaim you cash there are no guarentees & why should you?

    My first choices...

    1) All club together & pay for a locksmith to undo the padlocks!

    2) Out of the 10 of them someone must have a friend with an angle grinder! (also suggested on pepipoo I see)

Try to make sure as many of you as possible are there at the time should the clampers turn up. It would certainly bring matters to a head ;)

Far better to avoid paying in the 1st place than go through all the small claims stuff!

Edit: Plus what Hadeon said ;)

  • Do a sit-in in the other cars, they can't remove them whilst occupied. A touch of the local press and bingo. The one thing these goons hate is the shining light of publicity.

A couple of video cameras to record the whole thing, keeps a permanent record of events & makes great youtube viewing ;)

  • Problem is if you sue the landowner and win, the clamper will not pay, then you will end up paying anyway as they will charge it to the service charge.

You are being screwed here. Stage the sit in, get the angle grinders out and get as much publicity as you can.

It makes me incandescent with rage that this sort of thing is allowed in this country. It is outrageous.
