  • Yup - me thinks we've still a long road ahead girls & boys - but it's closer that it's ever been, thanks to your gentle shoves in the right direction and kind words of support, applause to all :beer: :T so fingers crossed.

    Here's to hoping that the LA absolutely fall over when they get my chunky envelope full of court documents and notes written in red pen... and then they soonafter get a call from ARLA notifying them that they'll be investigated for poor procedures etc.

    Like I said, here's to hoping! ;)

    Off to a birthday dinner tonight for a friend and another one on Saturday so plenty of opportunity to forget all about it until Thursday...

    Woooo - the world works in mysterious ways - I basically e-mailed one of my current suppliers a couple weeks ago as they offer PA telephone services, saying I am available in January and do they know anyone that might need my virtual assistance, and lo and behold just now a lovely gentleman called me who not only has a booming business, also seems very likeminded to me and will even set me up in an office in Brighton, with a possibility of running my own business from the word go, or eventually!!! Can employ me full time or as self-employed and sounds very interested - I am still in shock that he's called, as I was just opening the local paper to look for jobs (I'd only got to the bit where they offered free cinema tickets to see Miss Potter and promptly put it on MSE he he).

    :T More cartwheels, much excitement, chocolate fudge milkshake with no feelings of guilt! :T

    Not such a good day today. The guy I spoke to didn't call back today despite all his enthusiasm (he's in the midlands so I suspect he thought he could pay me local rates).

    Plus, got home and there's a wodge of paper from the letting agent's SOLICITORS defending their case and basically saying 'we had nothing to do with it, we always act on behalf of the landlord, says so in our contract, we're entitled to give back deposit to the landlord when they ask for it and present receips'. Plus they state as we have already got judgement against landlord we can't try to get it 'twice' which is ridiculous as we are not taking the LA to court go get the money from them, it's more to do with how they have handled things.

    Now I am worried about costs and them making us pay for the solicitors.

    All I can hope for is that they got our large package today too and it shows they why we are going ahead with this.

    They didn't supply you with an address that was servable (i.e. legally shouldn't have collected rent), further more their role is muddy, they gave you an address that was her decorators, they also offered to negotiate long after they declared no part of it. End of. It isn't malicious on your part. I'm sure it'll be fine. The laws on servable addresses and them supplying on demand are there precisely so tenants can take action and not hide being PO boxes/agencies you had no choice to pursue them as they were the ones hiding the landlady. Small claims very rarely award costs they advise people not to use solicitors because they don't usually award costs, where costs are awarded it's because someone has absolutely no case and is maliciously pursuing / wasting courts time.

    Thanks BB - will just have to see next week I guess. It's just scary and I imagine that is what they intended. It wasn't a nice chunky parcel to come home to - trying not to think about it and we are watching a movie in a bit and opening a bottle of wine.
