    go for ARLA now !!!!! - send cc to LA - this may well focus their mind on the court case and may force them into cooperating with you !!

  • I also copied docs to send to ARLA as we're going to file a complaint against the LA with them too. Any ideas as to whether we should do this now (so that ARLA may contact them before the court case and hopefully get them bricking it) or whether we should file it later?
    If their ARLA, was the deposit held in ARLA scheme?

    Everything sounds dodgy about these "receipts" you've listed, but this one is at least from a legit company. Is it worth popping in to the branch of Carpetright and asking whether this is the sort of thing they produce or not?

    If you mention the magic words that it relates to a Court case and potential tax fraud, I am sure they'll be more than willing to help!

    just so happens i bought a carpet from Carpetright this weekend. I can't remember exactly what was on the invoice we received, but it was certainly very professional and comprehensive as you'd expect - an A4 preprinted sheet filled in by the assistant and showing all costs, customer details etc. your receipt is almost certainly bogus

    The Letting Agent joined ARLA a few months after we signed tenancy agreement, so we are not covered by the deposit scheme - we asked ARLA :o

    Hi all - some good news, at laaaaaaast!

    My friend in the financial sector re-checked his data for the latest info today and called me a few minutes ago, and lo and behold if the landlady is not STILL at the last address, receiving bank statements and building society statements in November (she supposedly 'moved' in August - 3 months ago!).

    BEST OF ALL there is now a lovely CCJ sitting against her name / address - to the tune of £718 and showing our court case number!!!!!!!!!

    This means - she completely ignored the 1st set of COURT documents posted to that REAL address (which she returned to the court unopened) asking her to defend her case.

    This means - she probably received the 2nd set of COURT documents posted to that REAL address advising her the case had been won by us by default and for her to pay up.

    This means - we could in January go for Warrant Of Execution (bailiffs) as we finally know she still lives there now.

    My instincts were right - she never moved and was hoping to lead us up the garden path with this new address (which is her decorators, Gloria).

    I don't know what it means in the grand scheme of things, but it means I am a WHOLE LOT HAPPIER TODAY in the knowledge that even if we never get our money back, she now has a CCJ to deal with, and given that she has lived at that address for 9 years or so, it is unlikely she will want to move to escape a minor amount like £718 (she makes that on renting one property, in one month).

    The court will appreciate the details all summarised on a sheet and highlighted - it will enable them to scan and absorb the important detaisl of the case you are making - this will all help your case - good preparation and an effort not to waste the court's time.

    I can detect a new sense of purpose in you - well done - cheered me up no end!!

    well done EL this news has come just at the right time when you needed a bit of a "chin up"! Imagine how she is feeling! She's playing a dangerous game - and the courts aren't blind - she is more than a petty thief and will be lucky if the courts don't pursue her on criminal charges. All the more reason to lodge those dodgy tax evasion reports etc - she'll more than likely be following this up long after you have your money back....whenever that may be.

    I bet she rues the day she messed with you. And if she doesn't, she will!
