    Thanks Damo - I know what you mean - that's actually what we said to eachother when we left court - at least now the Letting Agent aspect, and the Address aspect are out of the way, we can focus on the unfair deposit deductions.

    Can anyone clarify whether a landlord is supposed to present 3 copies of estimates before carrying out repairs?

    Even if not, is the landlord meant to consult with us first?
    Careful demandign 3 quotes implies happy to pay and dispputing level paid, the lack of proper quotes/ receipts being less than convincing are an issue because you are questioning that the deductions were a) necessary (say this loudly) and b) tryign to imply unfair and just a scam with dodgy receipts for betterment/gain....

    :mad: Lying Landlady! Its a shame that the judge did set a side the judgement. Hopefully he only did it to give her the benefit of the doubt and a chance to defend her case.

    I think it is now likely that she will file a defence in the next 14 days. Should she forget or have to attend "hospital" again then todays effort will have been invain:rotfl:

    She will probably also file a counter claim. Your strongest defence to this has to be that if she believed you did owe her then why has she not pursued it?

    Thanks C *beams* - yeah, it's not been the result we wanted but at least it's dragged her into court. Although I must say I feel a bit bad because she did drop into the conversation that the reason she was in hospital so much was a cancer diagnosis - now, whether she actually got diagnosed with it, or it's still being looked at, it's hard to say. Either way, no doubt her daughter hates our guts for the stress (and seeing as the daughter did the check-out, in court she will no doubt be a nasty witness).

    If it's true though, it's not something I wish on anyone - this is a cliche, not even on my worst enemy 9which she is right now).

    Glad I inspired you - seems like lots of folk are getting something from my posts, it's the least I can do to pay you all back for your patience, advice and time you spend trawling here and elsewhere for information for me :T


    don't feel bad about her "illness" - i wouldn't even believe her. she has lied about everything else so far. (I used to know somone who'd always invent a cancer scare whenever confronted with another lie they'd been caught out telling....funny how we no longer speak!)

  • Thanks everyone - we went for a lovely Morroccan meal and it was lovely - you know, just right - like service wasn't too scarce or too overbearing, food was fab and wine was well deserved. I feel better today and like you say, we need to mention that the qutes were submitted one day and deducted the next, most of which are attributable to wear and tear based on a) our inventory and the state the place was in when we moved in and b) the fact that two of us lived there for 2 years.

    I will look at the 'Eagerlearner, Clutton and all help me' thread and read up some more. Thanks everyone and do keep thoughts coming.

    Read this thread from beginning to end, PHEW!!

    Being new to this forum thing it has confirmed to me how many great people there are out there willing to help others.

    My hat comes off to Clutton and prudryden who I think have been rocks throughout this saga, well done.

    What does worry me though is just how easy it seems to be to get away with something that is so obviously illegal.

    All the LL has had to learn is a few loopholes. However EL has had to learn the law inside out on this one. Where's the fairness there!

    Thank you all again for the superb insight into this, I know where I'll be coming should I need some help.

    Thanks Moov-in - it's def a long one and everyone here is in for the long haul - will still be another 2-ish weeks until the next case and in the interim we will no doubt hear all about her 'counterclaim'.

    To date she has had to pay £65 just to set aside the judgement, so she must really think she has evidence that's very strong to proceed.

    What if she just wanted the judgement/CCJ set aside for now so that she can apply for a mortgage within the next couple of weeks? Then if the CCJ went back on her file, she wouldn't care as she got the mortage she wanted? Just a thought - maybe I am being paranoid but I don't put anything past her now after seeing how she was in court yesterday.

    Thanks for your support - I was going to post today anyway to say that as of yet no news. I don't know if that's a good thing or a bad thing.

    The longer she takes means either a) she's loads of 'evidence' and is taking a long time to compile her defence with 'witnesses' being hastily rounded up, or b) she has no defence and is wondering if it's all worthwhile and c) she only wanted to get the mortgage application done and is waiting for the CCJ to dissapear off her record....

    I will post as soon as I have any news at all :o

    EL - When did you say your next court date was - was it next week? If she hasn't sent you copies of her defence you should contact the court and advise them so. Tell them that you haven't had the opportunity to prepare properly because of this, and you'd like to have this noted, and if possible, a sanction to be imposed because she is failing to comply with the court's direction. You're supposed to have a fortnight to review the other party's documents, and failure to comply with this should be taken seriously.
