T mobile i phone

A friend of my son was told by a lad he is a UNI with that T mobile were selling i phones, so he went and bought one. T mobile told him told him if it breaks to make an insurance claim as normal and not to take it back to them. Anyway when he got it home he put his T mobile sim card in it but it wouldn't accept it. He brought it to my son to help him with it as he is registered blind and thought he was doing something wrong. After trying to update the phone they have now realised that it is only unlocked to O2 and not T mobile. He paid £70 for this phone with a new contract and has since been told that T mobile are selling these phone from 'under the counter' as they have been bought off O2.
So does he have any rights here or not?

Somehow I don't think a genuine T-Mobile retailer will be selling "under the counter", locked iphones. I think he needs to check exactly who he bought this phone off.0

Those articles refer to legitimate sales, not dodgy dealings!
OP, was this phone definitely bought from a T Mobile shop? If so, it sounds like the phone is faulty and should be taken back to the shop for an exchange/ refund.Gone ... or have I?0 -
Would he not have needed a new 3G sim card anyway?0

Yep the phone was bought from a T-mobile shop (brand new) with an iphone tarrif and a 3G simcard.
The problem is that we needed to restore the iphone through itunes and then it would not allow him to use the t-mobile sim card they provided him but it would work with an o2 simcard (as o2 were the official stockist for the iphone 3g at the time) so we had to jailbreak the phone and then unluck it to allow him to use his simcard.Wow, I got 3 *, when did that happen :j:T:p

Surely giving an iPhone to a blind kid is like giving an iPod to a deaf person?0

If you've jailbroken it (i.e. modified the software), you'll probably have invalidated any warranty, and risked compromising other rights by doing so.Squirrel! If I tell you who I work for, I'm not allowed to help you. If I don't say, then I can help you with questions and fixing products. Regardless, there's still no secret EU law.
Now 20% cooler0 -

The Phone will still work with a 2G Sim you just can't use 3G functions with it. He should call his network and ask for a 3G sim to be sent to him though so he can get the most out of the phoneEnfieldian wrote: »Would he not have needed a new 3G sim card anyway?

He is registered blind but does have some sight, but he does find using any mobile phone difficult, he doesn't text very often as it takes him a long time to just do one messageWow, I got 3 *, when did that happen :j:T:p
