    Ive just stumbled across this thread after googling possible causes of the shocking state of my Scala "leather" 3 piece suite. It seems the issue is that its not leather at all!!
    I feel very angry about this situation and also a little unsure of how to proceed. I bought my Scala in March 2008 and the paperwork I have for it has the leather symbol on it with 100% written next to it and the description of the suite says "Created in practical durable leather,it oozes design thanks to detailed contrast stitching....."
    I want to take this up with FV on the grounds they have mis-sold me a suite but a few people have mentioned a 6yr deadline which I am now outside of by 5months. Does this mean I cant pursue this?
    Any advise would be welcome,thanks.

  • Hello all you scaly Scala scamsters. What a terrifically helpful thread - I love you all so much I could lick you. I wonder if one of you beauties could please send me a copy of the 100% leather leaflet that's being bandied about? I'm going to kick some criminal butt in court soon, and having proof of Furniture Village's laughably leathery lawlessness may help me whoop it harder.     Good luck, got my own battles with this store. Never again. £2800 sofa which looked dreadful within a year.
  • Hi All, Just want to update all of you who regretfully purchased a Scala Sofa from Furniture Village as I did in 2007.

    I took them to court and won and got paid out the full amount of the cost of the sofas plus costs, expenses and interest. A most satisfying end to a great deal of hassle. I won’t be buying my new sofas from Furniture Village.

    As far as the court was concerned my case was not limited to 6 years and I think this is relevant because FV were advised of the peeling problem in 2010 and they had a chance at this point to advise me the sofas were not the real leather they were sold as. Therefore I would say that you have a more than good chance of winning any court case against them if you purchased before the end of December 2008 when they changed their advertising and at some point within the last 6 years had reported the problem of the pealing to them.

    I would be prepared to provide you with all of the representations I made and you can adapt dates times and correspondence to your personal circumstances. I can also provide copies of advertisements obtained from public resources such as newspaper archives from your local library. For me Essex Library have digitized all of The Times published since 2006 so I was able to get what I needed from them online. If it helps I am also happy to provide details of the ruling as this could also be used to force Furniture Village to reconsider your claim against them without the need to go to court.

    Be warned FV, if it gets to you having to raise a small claim against them, seem determined to take it all the way to court however I think that they just hope that you will get fed up with doing all the paperwork for the court (most of which I have already done for you). I forwarded my case documents to the court and FV all within 1-2 days of the deadline leaving FV short on time to prepare any defence if they had indeed just been hanging on in hope that I would disappear. FV provided no representation documents therefore were unable to then present anything in court. Their only defence it would seem is the 6 year limitations statute from the sales of goods act which was immediately pointed out by the judge that this was not relevant to my case. FV asked their local store manager to attend court who had been advised only a week prior and was completely hopeless in providing any credibility to FV even if they had had a case. My detailed case notes had not gone unnoticed.

    Good luck to all of you if you decide to take them on and while there is never any guarantees you will win at least this may give you some confidence of some success which was all I was looking for prior to taking them to court.

    Please could you provide me with the documentation, I think that I will have to go down this route also.
