What i never understood was that if people were asked "why" they were claiming back their loans etc would they actually have to know why for themselves? Should they have been the ones to actually say firstly what they thought was wrong with their loans RATHER than being told by Loancheck what they thought was wrong?
I probably have not explained myself well here thomas123 but do you see what i mean.
If anyone knew that they were being mis-sold in the first place then they would not have a claim as they would be deemed complicit.
If they were made aware by others such as CMC's, solicitors, or even members of this forum, then in law that "date of knowledge" is the start of their chance to put things right.
PPI is relatively simple, but the technical breaches of the Consumer Credit Act are best left to the lawyers to sort out.0 -

I have a PPi reclaim with Watsons solicitors and have had a nightmare getting in touch. Finally got to speak to Mr Watson himself last month (after 3 months of leaving messages almost everyday) and he confirmed that their admin company had gone bust and he couldn't cope with the workload. So he was offloading all his financial claims to another firm. Black Knight sent me a letter about a week ago confirming this and said the new firm will contact me shortly. I really hope they do, When this case was started I was ensured that it would take no longer than 12 months I am now looking at the 18 month marker and it has got absolutly nowhere. Feel like just doing it myself after all. Should have listened to MSE!!!!!!0

Tell you not to just go for the PPI etc and tell you that you have a better chance if you claim other things? I always thought that a person had to know they had a claim first. If a case went to court could the client be called to say exactly their reasons for making the complaint cause i bet half would not know their reasons other than PPI?
The CMC's are taking a risk if they tell people that they have got a claim - that is down to the solicitors0 -

As mentioned before on this thread, Watsons should only pass their cases onto another solicitor and Black Knight are not solicitors.0 -

Hi Dixy lets hope that if it is being transferred to another Solicitors you will get some success. Please just make sure you have in writing from him that you will not be liable for any costs. Just to make sure. Let us KNow
how you get on. I have one with Watson after ringing Black Knight I was told that mine was not being transferred. Suppose that may change. Have written to Solicitor asking and am awaiting reply.
Good Luck and let us know.:mad:0 -

Surely Watsons would not transfer and waste another solicitors time if they thought they were not going to win but then again are they passing the buck? Also surely by passing this on without first asking if the client wanted it passing on (in writing that is) is not right or are they allowed to do this?
They are allowed to do this if they have not got the resources to deal with the cases
However, the client has to agree with the new solicitor that they want them to do the work0
