To be fair, I have noticed that some of the self serve tills in the ASDA near me don't beep. You have to check on the screen that the item has gone through.

The OP did steal the item. The police just decided not to take further action.
Putting an item into a bag without paying for it whether due to a self scan not scanning or not is theft.

Asda were well in their rights to request the police investigate and ban you.
  • Because if you swipe it and it doesn't beep, it LOOKS like you have swiped it but you haven't really swiped it. In fact by putting it in the carrier bag you have actually swiped it.

You can walk out holding your head high because everyone thinks you swiped it when you are actually swiping it.

Well, your avatar certainly goes with this post lol:rotfl::rotfl::rotfl:
Wow, I got 3 *, when did that happen :j:T:p
It is not illegal to open another persons mail unless you intend to commit fraud - this is frequently incorrectly posted:)
    I live in my head - I find it's safer there:p

So Asda self checkouts don't have that Tesco "Unexpected item in bagging area" noise?

An innocent person who does not deserve to be arrested would ask an assistant for help if it doesn't beep. They are obviously a thieving family.

No it isn't. There has to be intent to steal.

Wrong, Police and civilians alike have to have reasonable grounds to suspect a crime has taken place and arrests are only ever made "on suspicion" of an offence being committed. The police then investigate the allegation by means of interview, shop cctv, witnesses etc.

Not wrong. Police have extra powers of arrest. For a civillian arest to be lawful there must have been an offence actually committed.

A civilian has to know an offence has been committed, but can suspect a person of committing it.They cant just suspect an offence has been committed.
