I am quite surprised, as we were not informed of this special agreement (and I suppose we should have been), and because we were planning to start working on the flat tonight (my dad is flying over from abroad, he's arriving today) and yesterday there was still a lot of his personal stuff laying around, i.e. it makes working there quite hard even if he let us in.
There was no special arrangement, your mortgage company and solicitor would have insisted on vacant possession. Call the police, or just turf their stuff out yourself with a few mates and then change the locks.Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0 -
If you've completed, the place is yours! How can the seller give the keys over and then be surprised when the new owners turn up? I'd chuck them out (although I know this may be easier said than done!) - you don't want the insecurity of someone else wandering about in what is now your home.0

Change the locks or add a new lock of your own if that's easier.0

As others have said, there was no special agreement. I must say as well...I wouldn't put any of my stuff in there while this guy is still in there!!
Curious to see how this one plays out, would be my worst nightmare!0 -
If you haven't already, as I said earlier, contact your solicitor urgently but I also think someone's idea of contacting the Police (non emergency no) might be a good option too just to get their take - they may not be interested of course - civil matter etc but then they might be - won't know unless you ask.
I must say, I did say change the locks etc and while it seems the easiest thing to do right now I know in your position, while he is still about, you wouldn't want to make too much of an issue - people can be funny when their back is in a corner!
I really feel for you - bet it's taken the shine off your new place. Let us know how you get on - hugs!0 -
Most people start living in a property on the day they complete; what would you have done if this had been the case?0
-
The police won't help, this is a civil case, not crimimal. You also cannot forcibly remove him from the property or change the locks without a court order, this would be a illegal eviction. Contact your solicitor ASAP."You were only supposed to blow the bl**dy doors off!!"0
-
How can it be an illegal eviction when the buyers evidently now own the house?
The previous owner, via solicitor, rescinded ownership on the entry date.0 -
Would it be an illegal eviction though? Does he have squatter's rights? I really don't know?
Hopefully the reason the OP hasn't come back on here is because they are speaking to their solicitor right now.
I did say I wasn't sure that the Police would get involved but it's worth a try asking....0
