Contract law recently changed (a few years ago) and a signature is no longer required. If you take goods from a retailer and forget to sign the application for their store card (example), you are still legally liable for the debt as acceptance of the goods/service is implied and a contract is formed even without the signature.

The simple reason they hold your money for this length of time is due to credit card chargebacks which can come from a card customer 6 months after the purchase although this shouldn't be for all your transactions as some will have paid from a PayPal balance rather than direct from their card.
Yeah I know, it's definately still in the template letters they use though, or at least was in November, I think it actually does say that it was not agreed by signature, electronically or verbally, something along those lines. Would of thought the second part would suffice though myself as I can't see them sending you written evidence, especially if they don't have any.
Did you know you can get Viagra software now??? Yeah, it turns your floppy drive into a hard drive :D

To start i have been selling on ebay for years i have a couple of accounts all in good standing and as im a regsiered buisness they allow more than one account so im not breaching there rules in that way.
They allow one of each type, so one basic, one premier and one business. You can't have two accounts of the same sort.
I have now been limited with over £1400 in my account they told me i was linked to an old account in my name from 2005 to which i said provide me proof and i will settle any outstanding balance which i did it was due to a few chargebacks that they allowed all though i had sent the goods.
You appear to be admitting that you had a previous account with a negative balance, obviously trying to avoid paying that debt back and just starting with a new account was not a good idea. You should be clearing old debts if you want to run a successful business, not open a new account which would have been against their terms and conditions.

It is dreadfully unfortunate that this is going to impact on your business, and I would certainly be pushing paypal for a quick resolution to this issue. However trying to walk away with debts might have seemed like a good idea at the time but with hindsight it tends to come back and bite you just when you don't need it. We often get people on here that say they have opened new paypal or new ebay accounts to start again after being landed with a debt thinking it is as simple as that, we always suggest they sort out the existing problems first becuase at least then you know where you are and are not forever looking over your shoulder wondering whenn they will catch you.

  • Hi guys thanks for the reply i did not realise i had the negbalance it started of in credit of £3 somethign but because ebay suspended my old ebay account due to neg feedback they closed the account then a few fraudulent buyers clamied there funds back al though there was tracking but it was sent to the ebay address not the paypal so they refunded the customers.

Also this was a personal account and my new one is busness so im not breaching any policys on there terms i have not cleared the balance as this is the first i heard of it as i dont have access to the old account.

I fully under about chagrebacks but like another member said what about the payments from paypal balances and bank account transfers i.e echeques which prob make about 50% of the balance im sure if a rep took about ten mins of there time they could see this and release some of the funds but they just pass the buck and says its not down to them its another department.

There must be another member out there that can tell me if i could persue this in courts or do i legally have to wait for the funds that are not cc payments thanks guys

There is nothing at all to stop you persuing this in the courts. From previous anecdotal evidence it can get your funds released a little quicker (but not much quicker as the legal system is itself slow and paypal will hold out until the last minute before they give in). You are also gambling that paypal will give in and not fight.

However anecdotally all that happens then is paypal close your accounts and refuse to allow you to open another which is the end of your ebay business anyway.

I personally would be trying to resolve this on the phone, grovel for your previous misuse of a paypal account, apologise to them and promise never to do it again and maybe they will take pity on you.

Or possibly not as many of the threads appear to say give up and just open lots and lots more accounts and move on everytime ebay catch you. hardly a workable solution really is it?

I am having a similar situation at the moment - old account went negative thanks to a claim when a parcel went missing (I lost the tracking number, being an idiot). Paypal have not told me why they're holding my funds, so I plan to pay off the £30 or so negative balance once I get paid and try and get my £200 from my frozen account. I'm peeved as I gave them all details requested during their 'investigation' into my case.

Once I've resolved the negative balance I will speak to them again on the phone, though last time the phone operator said that it would be a breach of security to give me any further details...sigh.

Different types of account? Otherwise they have you bang to rights for having more than one account of the same type and could also claim you had opened the second account purely to avoid paying off the 1st debt. paypal don't like people walking away from a negative balance, and they will catch you sooner or later.
