Paypal account frozen yet again

Hi guys please prepair for a long first post
To start i have been selling on ebay for years i have a couple of accounts all in good standing and as im a regsiered buisness they allow more than one account so im not breaching there rules in that way.
I have been limited in the past for there so called eu money laundering law but after reading many posts and threads it seems this is not a law as such. I have now been limited with over £1400 in my account they told me i was linked to an old account in my name from 2005 to which i said provide me proof and i will settle any outstanding balance which i did it was due to a few chargebacks that they allowed all though i had sent the goods.
I explained when paying the £200 to them that this is my last bit of cash i have left its out of our mortgage money the assured me that if i paid before 3pm that day my accoutn would be lifted within 24 hours so off i shot to the bank to put money on my card to pay them i did so but 24 hours later i was still limited and now 3 days later after 20+ emails and 30+ phone calls. They have said the account is with a senior review specialist and that i will get a final decision with in 48 hours which is friday 3pm.
The main question i want to ask is yes i may have breached one of there t&cs with the negative balance but this is now clear and in postive standing they have told me they no longer wish to continue buisness with me which is fair enough after this i no longer wish to. I just want to know can they legally hold my £1400 for 180 days although they only allow customers to claim there funds back within 90 days this has caused me and my partner great hardship as ebay is 70% of our income and we use paypal for out website so will lose a great amount fo trade. But the fact they have my £1400 which was to be used to pay a few suppliers and pay mortgage and foods etc.
Im willing to pay court costs if any thinks i have a case againts them or do they have a right to hold my funds due to there policy breach of my old neg balance which has now been paid in full and they have sent me an email to confirm this although it does not yet show on my old account.
I have seen a few other posts with a few pre legal notices they i could try to issue but i dont want to run the risk of incuring more costs i will wait 180 days if by law i have to do so but why should they get away with this if its against the law.
I have a direct line which would be inclusive in most contact minute allowances and bts free landlines offer 0208-605-3000 just press 1 to get paypal saves paying the high rate 08707 number costs if anyone else needs to ring them but is yet to get this number.
So a quick recap guys they have over £1400 of my hard earnt cash for goods i have sent all but say 5% of goods which i refuse to send until i know whats going on i would rather send refunds than wait 180 days for my funds. I have sent all the info they have asked for inc passport, bank account details, utility bills and yes they did try the scam saying that it was not clear enough so i sent an ebill which they could not argue with. I am slowly running out of things i can do and say to them any help would be great.

Sorry, I can't help with the specific problem, but I can't understand why you left a balance of 1400 in the account. I withdraw it as soon as it goes over 6 pounds!

I had that amount because i run a business and payments dont take to long to build to that amount and as the accounts been open for over 2 years maybe more i cant see why i should not thanks.0

£1400 is not a large PP balance at all if running a business.
Been there done that with the PP holds with some very large figures, its not due to the 90 days customers can charge back via PP they are also worried about chargebacks via the credit cards.
Its frustrating when its your funds but understandable afraid you will have to just wait it out, they always release when the day comes.
If you are not ready to send the 5% of orders left you need to refund those customers asap.0 -
I have explained to the customers the issue and the ones that were happy to wait until i got the decesion will do so the others have had a full refund0

Ive got a similar problem dating back to August, its now been 6 months / 180 days and when I emailed them they said I have to wait 180 days from the date I emailed? It seems everytime you contact them the 180 days starts again?
How do I even withdraw the funds when the 180 days is up? well ive just logged in and found they keep transfering my balance from £ to euros and back and I have an amount of £5.92 deduced last month for currency conversion off them! so i doubt ill get my money back

It happened twice to me!
Both times after the block Paypal allowed my account to receive funds through my sales on ebay but I wasn't able to do anything with it. That was really taking the p*$$...! fattening their own pockets!
This is how it went:
The first time I have waited. Out of pocket for so many months.
I felt really cheated, it was more than 180 days anyway. At the end they stopped replying to my emails and just kept the money I think it was released after 8 months or so with their "your funds are eligible to withdrawal"..
The SECOND TIME... well...
The second time I have refunded all those buyers who had ALREADY RECEIVED their items until I reached a ZERO balance on my PP account then for a few days I kept doing the same thing: one sale=one refund keeping my balance as close to ZERO as possible expecting eBay to suddently shut everything but they didn't... I even lowered the prices on the listings.
Then I sent an email to all the new buyers explaining the situation and suggesting they file a complaint with paypal for Item Not Received as this is was the only way they could eventually get their money back.
The same day I cancelled my credit card and made sure the nothing was going to be paid out of my bank account.
During the sale/refund period I upgraded all my listing to "bold", extra pictures, etc. and I didn't pay any of the fees just to make sure they got the message.
A few days after I was the proud owner of a Paypal account with a negative balance of a few hundred £££ and a similar situation with eBay.
You can now imagine all the emails from PP asking for all sorts of things, papers etc.
I simply replied saying that I will keep the account this way for at least 180 days :rotfl: :rotfl:then I will revise the situation... :rotfl::rotfl:
also that they have the obligation to protect the buyers refunding their money from their stash.
I know some of you think it's criminal but I feel quite good about it, kind of payback. They have been doing it to so many people and ruined businesses without reason we all have to pay rents and mortgages at the end of the month and even £100 make a big difference to our life.
These people at Paypal are holding millions of £££ that doesn't belong to them and I am sure they are using this money for investments or using it some other way generating even more cash.
Of course I have no proof for this but I don't believe an organization like PP doesn't have a scheme for using such a large amount of money and they keep refreshing this "floath" releasing and holding more day by day.
Now I sell through my partner's account as Paypal wrote to me saying
"... we are no longer able to have you as a customer." :T:T
By the way, several of my "refunded" customers who received the refund along with a short email agreed to re-send payment to my partner's PP account as they were obviously pleased with their purchase. At the end I didn't actually lose so much, perhaps considering the eBay fees I didn't pay I think I made some profit.
Before you ask: no, they didn't chase me, they keep emailing me but no letters... not here at least*_*_* Department of Redundancy Department *_*_*0 -
In regard to the OP, as far as I'm aware Paypal still don't defend themselves in court unless they have to which is why so many of these companies keep springing up on the net saying "we can get back your held funds, 100% success rate". The main areas they work on is that if your paypal account was opened before the payment holds were announced then you agreed to those original conditions and simply updating their agreement online is not enough since you would need it in writing and would need to have signed it yada yada, and the other is that they need to supply you with reasons in writing within a time limit why they are holding your money (which of course they can't as they only know how to copy and paste emails).
Thats basically what those companies that charge you to claim do in a nutshell, and to be fair it seems to work, mainly because they don't have the resources, time or evidence to be in a position to defend themselves I would assume.

Contract law recently changed (a few years ago) and a signature is no longer required. If you take goods from a retailer and forget to sign the application for their store card (example), you are still legally liable for the debt as acceptance of the goods/service is implied and a contract is formed even without the signature.
The simple reason they hold your money for this length of time is due to credit card chargebacks which can come from a card customer 6 months after the purchase although this shouldn't be for all your transactions as some will have paid from a PayPal balance rather than direct from their card.0
