Vodafone change their upgrades policy

Already effective, all vodafone customers (new and existing) can now only upgrade 50 days before their contracts end. It used to be 60 days

Could be something in the T&C's that will allow you to cancel contract but you need to show that the change has caused you a 'disadvantage' under the T&C's.

Any feedback?

    Actually it used to be 70 days but even so..

    Upgrades are usually permitted within the last 30 days, when you are about to leave and in the last month anything over and above that is at the discression of the person who you talk to. Remember you signed the contract they can say no upgrades till the end of the minimum term.

    You'd be very hard pressed to say there's a change to your disadvantage by them making a upgrade period they give as a discressinonary period ten days less when don't even have to offer it to you at all until you've finished the minimum term.

    When i purchased my phone i was given discounted line rental for 15 months, when i asked for 18 months discounted they told me that i would only have to pay full price for one month as i would be able to upgrade 60 days before the end of my contract. - therefore that is part of the contract that was agreed between myself and vodafone.

    The fact i will now not be able to do this clearly leaves me at a disadvantage in my reckoning?

    They are also supposed to advise you in writing about changes to your contract and you then have 30 days to contact them about said change. The minute i receive the letter of notification i will be contacting them to advise them i wish to cancel due to this disadvantage.

    If you call them on 191/151 and select option 1 then 4 it still states its 60 days........ however if you then hold to speak to someone they tell you its 50 days...

    If you have it in writing you may have a chance. But I suspect you won't. Verbal contracts are legally valid, proving them is another thing.

    They DO NOT have to inform you in writing, they can text you or tell you to check the t&C on the web, or even in the T&C you have say parf of that is to monitor the offical t&C of use online. Continued use of the service is considered acceptance of the change. Sucks yes but legally valid. Just like your employer can post a chyange to your contract on an official notice board and it's deemed accceptable, you are supposed to check such official forums.

    7.1. We may change our Charges and/or introduce new Charges from time to time. If we increase our Charges, we will give you at least 7 days notice. If we believe any change in our Charges will not disadvantage you, it may be included without notice.
    7.2. We can make changes to or withdraw Services at any time and we can make changes to and/or introduce new terms to this Agreement at any time. We will give you at least 30 days notice of these changes if we do and you may have a right to end this Agreement under clause 11.

    Any change that means i will have to pay more than previously expected will put me at a disadvantage...

    Actually (And I've posted this in the other thread) read that contract again. If you try and quote it to them they can easily point out there is no discressionary period for an upgrade and hold you to the end of the contract, or chage you an extra fee to upgrade to hit the end of the contract (under section 2.2)

    You would be very had pressed to say a change of 10 days in a period that is at Voda's discression is a change to your disadvantage.

    You knowingly expected to pay 15 x discounted rate plus 3 x normal rate, with the expectation you could upgrade to an unspecified new deal after 16 months on just one month at normal rate.

    You now will pay 15 x discounted rate, 1 month aand 10 days at normal rate before you can upgrade.

    Remember this is an UPGRADE, you cannot cancel the contract at this point so you'd still have to pay something, and as I said in the other thread in my experience you only ever get pants deals until you are in the last 30 days anyway.
    In real terms the cost to you is something in the order of £10 to £15 (that covers up to a £45 contract). On a contract costing £450 over the term (thats at £25 PCM) then £9 extra is not really a significant disadvantage it's less than 5% or so. You have NO guarantee even if they upgraded you at t-60 days the contract would be cheaper, it could be the same comtract cost or higher just on a new phone.

    The term significant disadvantage is not defined in the contract but a tenner on £450 is not significant , it's probably less than you didn't pay under the vat change.

    Good luck getting the contract cancelled, I just can't see how such a small amount can be classed as a significant disadvantage.
  • at the time of taking out my contract (july '09) i was told that i could upgrade 90 days before my contract ended... that's almost twice the amount i'm allowed now.
  • Don't forget that if you upgrade before the end of the contract, you still have the remaining term of the contract to run plus any new tie-in.

    Therefore if you upgrade 2 months before the end of your contract, and your new tie in is 24 months, you will now have 26 months to run before you can terminate the contract.
    Why pay more than you have to?
  • well according to a mod on the vodafone forum, it's not a change in t&c's...

    "it's a change in business rules, and business rules are subject to change at any time"
