Insurance excesss

Hi all,
Hubby's car has been written off, he was hit by someone when the roads were icy, and the insurance co have said its a complete and total loss, and offered £2050 less £450 excess.
My question is...can Hubster claim the excess back from the guy who hit hims insurance company, or is it something you have to lose wether its your fault or not?

He has GAP insurance which "should/will" pay off the finance, but I'm not sure who we pay the £450 to, and when we will have to pay it?

    Part of the Furniture Combo Breaker
    when my mates car got written off they took the excess out the payout. I.e.
    payout £5000,
    excess £500.
    actual payout £4500.

    You always have to pay your excess when you claim off your own insurance. (As advised, this will be deducted from the settlement cheque).

    You can try pursuing the third party for the excess (and any other out of pocket expenses), though you will need them to accept they were responsible.
