Dialaphone/Allianz Cornhill insurance issue

I'm looking for some help guys. I bought my phone through dialaphone in December and was pretty happy with my deal until my phone went missing on Saturday. The last week has been a very stressful time for me (details don't matter) and it wasn't until late on Saturday that I realised I didn't have my phone. I honestly could have lost my phone or had it stolen; I can't be sure either way.
So I phoned the police and spoke to my network provider to get the phone blocked. Checked where I had been to see if it could have been handed in.
Anyway, I rang the insurance company and was shocked to find that they are refusing to pay out for the phone as apparently my policy doesn't cover "accidental loss or loss that you cannot explain". I'm shocked as it appears as useful as a chocolate fireguard. I'm trying to lay my hand on my paperwork, but I was wondering if anyone could explain my rights with respect to dialaphone and what I believe might be the misselling of insurance - I have a number of preconceptions on the issue and would appreciate any help in clarifying the following:
Has anyone else had any experience dealing with dialaphone/Allianz and this insurance policy?
Is it legal to sell a phone at a price on the condition that you take insurance on the phone?
Is it legal to sell insurane without getting the customer to complete a demands and needs statement?
