which is more common - is there a rule?
refund then return of goods
or return of goods then refund
someones insisting i refund them before they send the goods back
but if i do that i have no recourse to get my money back if they dont pay up
but they will be able to get a refund from paypal if i dont refund

If they file with paypal as 'significantly not as described' paypal will tell them to send the item back before they get the refund.
Have you tried the logic that they wouldn't expect a shop to refund before they'd sent the item back?0 -

they have just kept refusing so far so have said if i dont get what i want (put nicer) they will just recieve a nominal refund for the fact that they arent happyYes Your Dukeiness

Don't refund the money until the goods are returned to you. Thats only fair and the buyer should pay the p&p to return.0

Make it clear that you won't refund unless he sends the item back. I suppose that you must have sent the item by SD so you have proof of delivery (his signature). If he still refuses let him do a chargeback. Paypal will need him to return the item by trackable means before they refund him so you will get your item back and he will get his money back.I

You might also want to point out to him that Paypal won't refund him anyway unless he sends the item back. Maybe he is unaware about that. Hope you get this solved soon.I

since i quoted that paypal will tell him to send it back before he gets a refund he'll change his tune but he wants me to pay for it (postage that is)!!! where does ebay stand on this?
dont fancy arguing with him for much longer! and can i get my fees back by getting him to agree to the dispute that we mutually dont want to continue transaction even if i its got to the extent of refundsYes Your Dukeiness

He can't make you pay his return postage. Frankly if he'd been so cocky with me I wouldn't.My TV is broken!

ive said i will refund the postage he paid me but not the postage of him returning the phone just to stop the headache hopefully he'll just agree and we can get it over and done with!Yes Your Dukeiness
