Bad neighbours - Eviction?

Hello, i have recently been staying in a rented flat for the last 4 months. The tennants above me are beyond of joke , they bang around at all times in the day mostly at night. There banging causes the lights to shake that hang from the ceiling and it is really disturbing when trying to sleep.

They argue with most of the other tennants in the building, smoke grass and stink the flat out. Upon speak to the land lord, its a block of flats owned by a company. The flats are all private and no one receives any housing benefit or anything. According to the landlord they have not paid there rent for the last 2 months, they were previously given an eviction notice but the tennants challanged it on the ground that the notice was not within the laws. Now the land lord is saying that they are really stuck in a position and need to wait to there tennancy is up, Can you suggest anything i could do/ land lord could do to get them out asap!?

  • would the police come out for smoking dope? call them just to annoy them if you don't expect repercussions- i really emphathise with you for that, lived in a room next to someone in halls who did. it stank

    does your landlord understand how to serve a section 8 properly?
    maybe he could help their landlord to help you?

    although i've heard of people being served a section 8 then paying £5 or something so the landlord has to wait another 2 months but not quite sure about this

    Noise needs to be reported to Environmental Health at your local council, and you will need to keep a full diary. Illicit substance use needs to be reported to the police. I am not clear from your post if these tenants are renting from the freeholder or renting from a leaseholder?? Is their landlord the same as yours, if so what relevance is the company who owns the building?

    In the short term purchase some WAX ear plugs which are absolutely brilliant, nothing like the foam ones. I have insomnia and these make a world of difference.

    The renting from the same landlord, the company is quite big and has several blocks of flats. We have reported all the noise and drug use to them and all they do is go to their door and ask them to stop but this doesnt seem to have much effect especially with the noise. We have tried confronting them and banging up but they do it even more and louder just to annoy us. Its really getting too much and i have went down to the landlord and all the say is wait until their lease is up even although they havnt paid rent.. i dont get how this works...

    Are you sure they are not dealing or growing in the flat? If they are it is serious and the police will have to raid them for it. If they are call crimestoppers to report thye are growing and or dealing drugs from their falt.

    I dont think they.. it is not all the time that the smell is there only sometimes and when they have a crowd of friends in.
  • your landlord admitted he did not serve the section 8 correctly/

    have you asked him if he has served a section 21 to them so he can evict them at the end of the fixed term- how long is their fixed term btw?

    Their fixed term was 6 months, which is due to expire on 10th of March. The LL said just to leave it untill they leave as they will be receiving a letter on the 13th saying that their lease is not getting kept on. But it seems they are getting worse because they know they are not getting kept on. Everyone in the flat is either working or studying so really its unfair that they dont work and just bang about all night...

    Is their a way to get them out or get us out early within our rights? so we dont loose deposit
  • A neighbour's anti-social behaviour is not your landlord's responsibility unfortunately. This is the province of your local authority's Anti-Social Behaviour Unit and most LA's have them, I understand and they are not necessarily solely concerned with LA tenants.

    It looks like your landlord is sensibly taking steps to ensure they leave at the end of their tenancy so if you're lucky this might be resolved satisfactorily quite soon.

    You can only get out of your current rental property early under certain very specific circumstances and this depends upon the kind of tenancy you have with your landlord.

    Is the landlord serving notice to quit on the 13th? Because that means three more months (notice is two months coinciding with a rent period, which he will have missed by three days), a fixed term tenancy doesn't expire it becomes a periodic tenancy. You need to contact the appropriate authorities - Environmental Health, the police and the antisocial behaviour unit.

  • Hi Tam, I know exactly how you feel. I live in a block of flats and last year we had a couple move in who were an absaloute nightmare. Myself and the other residents in the close contacted our Council's anti social behaviour team and they were evicted in around 6weeks. Not saying this will happen in everycase but it is worth giving it a try and see if they can do anything to help.
