Help , Ripped, Scammed on What to do...Paypal the gits

Hi, all bear with me on this one.....

I sold an ipod back in jun for £165 to an ebay buyer, he paid by paypal and provided a confirmed address. I send the item special delivery to the address.
2 days ago i received a dispute mail from paypay reguarding the payment was on hold and pending a reversal, i was to provide all sort of information to which i did apart from the tracking number to which i did not have but am seeking it from the royal mail.

Now today i've received another email from paypal to state the reversal was completed and as such i'm out of pocket £165 or an ipod.

Now after tracking down the postal address and managing to location a telephone number from bt , i called them to to see what the score was. It turned out that they were not the buyers but only the recipents of the ipod!!!

So whats happend is that another seller (A) has listed an ipod and some one bought it ebayer (B), now the seller has then bought an ipod from me seller (C) to which i posted to ebayer (B) as i was supplied there address from seller (A) to which i was unaware of. A complete trangle of a mess...

Seller (A) has ripped me off and buyer (B) now has a new ipod and me seller (C) loses out.

What are paypal doing about it ....NOTHING. when i get the tracking number i'm hoping they will give me my funds back under the protection policy..I'm also unhappy they they only gave me 1 day to respond before compling the reversal of payment.

Can anyone advise what position i might be in reguarding fraud,etc? am i in my right to ask for my ipod back from buyer (B)?? or do i need to pursure paypal with all my might.

On another note i have contact other people that this seller has crapped on to obtain omre information and someone has provided me with an unconfirmed address of seller (A) to wich is only 15mins away from me so I'll be paying it a vist on my return from working away.

Any advise is greatfully received.

    Sorry, I don't understand. You say the person who bought it from you had a paypal confirmed address and that's where you sent the ipod and where you can prove it tracked to?

    If a third person was involved I'm not sure I follow how you have a paypal confirmed address that isn't for the right buyer?

    I would get legal advice if i was you. Then take the !!!!!!s to court (paypal i mean)

    I've re read the post..your contract is with buyer A not with their buyer, therefore if you had sent the ipod tracked to the address on the paypal payment from the original buyer A then B can't claim from you as they were not involved at all, their contract is with their seller A.

    If however you sent to an address given to you by A but not their paypal confirmed address then you don't have any seller protection.

    Also, I am a bit worried as you say you didn't have the tracking number and are trying to get that from the Royal mail (present tense) if you could not supply that tracking number, and a fax of the silver special delivery slip to paypal within the 10 days then you would also automatically lose a chargeback.

    Sending an item special isn't sufficient, you must have the paperwork available for paypal to prove it was delivered and that means the original silver SD slip if they ask for it.

    I am over cautious and keep a box file for all my COPs, recorded delivery slips and SD slips and tend to keep them for a full year.

    I'm not sure I understand. Usually in an eBay transaction there are just 2 people involved, a seller and a buyer. Where has this third person come from?

    If you couldn't provide the tracking information then I can understand why PayPal went in favor of the buyer.

    provided you shipped the item special delivery to the confirmed address that the account holder of the paypal payment sent to you

    AND that the transaction was eligble for seller protection then, you have every right to be annoyed

    something doesn't smell right here though, and i'll have to say, if you can't provide a tracking number, in a timely manner to paypal, they will ALWAYS side with the buyer

    sounds like that you've fallen for the old classic paypal scam
    'post to this address please, (non confirmed address here)'

    as for paypal only providing one day, that seems odd too, as much as i dislike paypal for large transactions (https://www.bleugh.co.uk/paypal) i don't think we're hearing the whole story here

    I have to say that I got confused with the original post! Was the item posted to the address given in the paypal transaction?

    Just tell the truth and hopefully paypal should reimburse you

    yes, the item was posted to the paypal confirmed address, however it was NOT the buyers address....but to another person who had bought an ipod (the same type) from the buyer.

    I will get the tracking number but no longer have the silver slip from the PO. what chances do you think i have against paypal?

    so, who did the payment come from then?

    if the confirmed address was that of the person that has now received the IPOD then they're the one that has ripped you off


    ultimatley here, who exactly owned the paypal account used to pay you?

    is it possible that your two third parties are the same person?

    So how come you have a paypal payment from someone who didn't buy something from you? When an item is sold you get the usual end of auction email, and then get a paypal payment with the address showing..that can be double checked as it will of course be in your paypal transaction page. That's the address, that's your buyer and that is where you have to prove delivery to. Anyone else claiming non delivery isn't in a paypal transaction with you so I can't see how they can even start a chargeback :confused:

    Paypal allow 10 days for you to prove delivery..that is not usually extended. Then the tracking number needs to be provided that shows online that the item was delivered. Then in all the cases I have heard paypal require a copy of the SD slip to be faxed through, as otherwise the system would be open to abuse and a false tracking number that just happens to track could be provided. That SD slip needs to show the paypal confirmed address (ie the one that you get when you check the transaction in your paypal account). If the address does not match the one on the paypal payment that you received then again you will lose.

    You say you don't have the tracking number, so how do you know it shows as delivered?

    Re your final question, I've not had a chargeback so I am working from anecdotal evidence but I'm sure bleugh or someone else will be along shortly to correct me if I am wrong, but I do think that if you do not physically have the silver SD slip then you are likely to lose the chargeback.

    thats correct, BUT, if you know the rough date (within a few days) AND the post address / postcode, a very nice RM person will look through the special delivery records for you to find the information. All the post offices i've been to, they record ALL the special deliveries in a book.

    otherwise, no slip = no tracking number = no delivery. you don't NEED the slip mind, just the tracking number
