    Well they are not really 'unauthorised' - you implicitly agreed to them when you booked.

    Admittedly you didn't know the cancellation terms though

  • Making a restaurant reservation is forming a verbal contract to which your agreement is implicit, and if you break the contract without the acknowledgement of the other party they are, I believe, within their rights to claim from you the cost to them of the loss of business. It's not a policy that I would pursue in my restaurant, but I believe that some restaurants (those that can afford to lose trade) can and do.

    Thanks for all your support. I have asked the online Trading Standards who sort of confirm what some of you have said, that the restaruant can claim some of the money in addition to the deposit. However, they say that it was completely wrong of them to take money from my credit card without my authority. iIonly paid and only intended to pay the deposit with i and and didn't agree anything further. They have suggester di write to the cc company quoting fraud requesting them to investigate a fraudualent act and if they do nothing then to go to the ombudsman. I may still have to pay some of the balance.

    Hope you never need this info but if you do hope you can use it.
