What I think will happen is this (figures for argument's sake);
You get £5,000 overpayment refund in a lump sum from the CSA ie the taxpayer. Your assessment is £10 per week. You pay that £10 but only £5 goes to the PWC, the rest to the CSA to repay her overpayment debt. You've already got your overpayment back so if your assessment was reduced too you'd be repaid twice.
This is what I think, I'm not 100% sure as this is not the area I specialise in; you really need to speak to an accounts officer (I know about debt).0 -

Not quite though
When i win my appeal the SOS debt is cleared
The pwc has been paid too much resulting in the CSA reducing her weekly amount as she was overpaid anyway
Why should my liability stay the same as i don't need to pay the SOS to subsidise her benefits .if i stay the same am i paying for a CSA mistake ?

I think it works this way, using your figures above as an example.
Liability is £250 (I'm not sure if this is including arrears but I will assume not)
That £250 would normally go to the pwc (or split between the pwc and SoS if shes on benefit)
If CSA have cut the payment to the PWC to £125 (because she has been overpaid and only for that reason), that is what she will receive, with the other £125 (that would normally have gone to her) going to repay the debt on her behalf.
So officially she still receives £250 but you are forwarding half of that to the CSA on her behalf to repay the debt she owes. Think of it as missing out the middle man if you like.
Only thing that changes my example is if the CSA have re assessed you to pay £125, then I cant explain where the other £125 is going or what its for - check that out with your caseworker if that is the case.. If you have been re assessed at £125 the same principle as above will apply as part of your payment will be diverted to the CSA to repay the pwc debt.

After appeal my account is square (after they have refunded me) £0
PWC has been paid too much so they 1/2 her payments to £125 from £250
NRP no longer has to subsidise the benefits system for pwc benefit
Should i stay at £250 liability ? or only pay £125
I reckon it would be the £125 as pwc has been overpaid anyway and i don't need to subsidise the benefits system or pay for the pwc debt0 -

Sorry, can I just clarify then.. if the pwc is overpaid,works full time, so I assume recieves the full assessment amount, do the CSA just make a request to the pwc to pay an overpayment back or is it actually coming from the csa??0

PWC doesn't work but is not on a CSA subsidised benefit i.e income support etc
If they half her payments due to overpayment i think the NRP's payments should be halved as NRP doesn't need to subsidise pwc's benefits0 -

Ahh no, sorry, think I was sort of inadvertantly hijacking your thread lol, as in a similar situation,and noted your overpayment circumstances in relation to mine so wondered if my understanding was correct as to why an overpayment was not returned! Sorry!0 -

Did they cut your money due to overpayment ?
Interesting to see how the CSA progress this one as no one in the CSA seems to know either .Mines is a clerical case also so that would add more confusion too .:)0
