    Not necessarily, if over payment is due to agency administrative error, although the PWC will be asked if they are prepared to repay, they can refuse.

    The agency should refund the NRP for over payments made because of agency error.
    A fairer CSA for all

    I was going to pay it off but i don't want pwc getting her lump sum then the CSA come back and say we made a mistake pay me(nrp) back then can't get the money from the pwc as CSA's mistake :)

    Have now got them to extend the arrears over 2 years as originaly it was 12 months .He has still calculated it wrong though .Appeal just round the corner and counting.So by that time the pwc would have ben paid too much anyway would the CSA just stop her money as they can't assume the child is a qualifying child forever .
  • Ooh this is a bit complicated but from experience/memory I think if you win your appeal, and the system is adjusted accordingly, you will be due a refund which the CSA will pay out to you more or less straight away (before they get it back from the pwc anyway). They will ask the PWC to repay her overpayment but can't force her to; while the case is open they will reduce her regular maintenance by a certain amount instead to try to recoup it gradually. So no, they won't stop her money altogether; if they haven't recouped the overpayment through the reduction of her regular maintenance by the time the case closes due to the QC not being a QC anymore, the taxpayer will pick up the bill for the overpayment and she will keep it.

    After i win appeal the my SOS debt would have been paid also the PWC has been overpaid .What will my liabilty be then as if the PWC is on a reduced rate payable to her will my assesment go down ?
  • No your assessment will be unaffected, as you will already have been refunded what you overpaid. At least I think so, my brain is hurting slightly. :)

    It's a hard one that

    Folks Anwers on a postcard please:rotfl:

    She is not on a SOS subsidised benifit now so i wont need to pay that
    She won't be entitled to her full CSA assesment as she was overpaid anyway

    Why will i need to pay the full maintenance ?
