faulty mobile handset.. 12 month warrany expired but still in contract period

hi
can anybody help I have a sony c905 handset with orange

it is under contract for 24 months started nov 08 .

the handset is now faulty but after calling orange they say the 12 month warranty has expired therefore they will not repair/replace my phone but will continue to charge me for remaining contract .

surely if I enter a 24 month contract they have a responsibility to provide me a warranty for the same period thus allowing me to utilise the service im paying for.

can any body offer any advise ? is this legal?

  • it should have a 2 year warranty (that handset has a 2 year warranty with tmobile).... and whats upwith the c905 exactly? i know its one of the worst handsets out there at the moment but most issues it has can be rectified by a software update from sony ericsson website....
    does my bum look big in this sig?

    SonyEricsson products have a 24 month manufacturers warranty if i remember correctly.

    SE will fix it under their 2 years warrant.
    Orange are right in this, you still have the sim card which you can put in any other phone and still use...
  • I was led to beleave my phone had a 1 year warranty thats what orange told me

    the problem is with the screen if i open the clam on the phone and shut it again the screen goes multi coloured

    I think "warranty periods" have been successfully challenged in the courts before. If they sell you a 2 year contract then you should be able to use their hardware for that period without impediment cause by fault therein.

    I'm sure they have, but what would you rather do, post it to SE and get it back in a couple of weeks. Or go to court and wait for months ?

    I'm not saying that the networks in the right/wrong but if the manufacturers will fix if, then why not. . .

    I probably would try the manufacturer's guarantee but you appeared to imply that because you could still continue to use the sim on another handset then this would absolve the network from any responsibility. I agree that they continue to supply you with airtime, but you will generally pay a lot more for airtime when it includes purchase of a subsidised handset compared with sim only airtime.

    The warranty SE offer is 24 months. Your retailer (Orange) is responsible for this. I would call them back and tell them this. If they refuse to assist tell them you wish to make a formal complaint. Don't let them fob you off, ask for a supervisor.

    It's probably quicker and easier to go directly to SE, that way you cut out the middle man and should have your phone back sooner.
