This loan was for an ex-boyfriend, because we spilt up I did not pay and defaulted. The intal loan had two (if I remember correctly) bridging loans added to it, I think it must be 15 years old.
I thank you for your advice, still reading but due to still being upset it is all a blur. I will get letter off to Triton.0 -
One other thing I forgot to mention, even though I have been paying 4o.oo per month off this load I have never ever received a statement from NW in over ten years, so I do not even know ehat the debt consists of?0

If there is even a glimmer of a chance that there was a six-year period (five in Scotland) when no payment was made then you should assert that the debt is statute barred instead.

Sorry for bothering again, However as this debt is over 10 years old and I have being making payments each month, can I still pusue the CCA? Sorry I am so confused. This debt is a loan that consists of two or three bridging loans, it is that old I cannot remember. All I know is that I have never received statements for monies I have paid over years, I have just carried on paying!
I cannot even remember the amount of the intal loan, will this all be stated on the CCA? Will NW send me CCA for teh additional bridging loans?
I am so confused with all this, Just to upsetting.
I have been depression free for 18 months now, as previously was seeking medical help. Trying to keep myself togeather as I do not want to go down that road again...0 -
Absolutely FB, dont just assume that the ****ers know what they are on about.
Debt Collection is a lot of smoke and mirrors. Threats of what they MAY do, what COULD happen etc,etc.
Take the upper hand with our help and this can be sorted.

Write to Triton and demand the CCA.
I assume that they have also put a default on your credit record at some point (quite possibly so long ago that it has fallen off your credit record now)?
Unless both the CCA and the default letter are legally compliant, there are quite a few loop-holes between here and successful legal action on their part. What will be important is to get as much ammo as possible together, then if they try anything, you will already have your defence in place.
Given the appalling behaviour this morning, I think you should send the telephone letter to AIC and Triton, which will have the advantage of ensuring that they have to send you some reference numbers on which you can make a Subject Access Request.
So take the rest of the weekend gently and it will be OK.If you've have not made a mistake, you've made nothing0 -

I am writing in relation to the quantity and frequency (nature) oftelephone calls that I have received from your company, which I deem to be personally harassing.
I now require all further correspondence from your company to be made in writing only.
I am of the view that your continued harassment of me by telephone puts you in breach of The Consumer Protection from Unfair Trading Regulations 2008, and the Protection from Harassment Act 1997.
If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.
Please treat this also as a formal complaint, and send me a copy of your company complaints procedure.
Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)

Once they have signed for it, record every single instance of a call, advise them that you are recording all calls and once you have a few calls from them make a formal complaint to the OFT.

RAS many thanks. This was my first call to AIC and my last. I cannot believe the state I have got myself in, I could not believe they were asking my work details and asking me to borrow money off my elderly parents. The guy actually said what tell me what you are going to do to get this money togeather?
I think I will also contact the Ombudsman on Monday to report them0 -
As you know, advising debtors to borrow money from others is totally against OFT Guidelines.
