I have just recived a yellow card today from the above company. I rang them straight away and ended the call in tears. I have a loan debt with NatWest which is over 6 years old. NatWest passed it to Triton who i have been paying each month. On the 1st Feb I contacted Triton and they reset my plan as it come to my attention I was in credit on an old current account of 145.00. The lady I spoke to on Monday advised me not to pay this month and she would transfer the 145 over to the 5.930.68 debt, and that my next payment would be 28th Feb.

I was shocked to receive a card from AIC today. I live with my elderly parents and do not not want them getting calls. They are asking for all the money which I do not have, even my parents do not have that sort of money. They will take no offers and are threatening me with court.

They asked do I work and asked the name of the company and city, I gave them this info and I am now unconsoleable as do not want ant trouble at my work. This loan consists of two bridging loans that NatWest made me take out.

I would be rateful if anyone can please advise me.

Were Triton acting 'On behalf of' Nat West, or did/do they own the debt?

    Same Question about AIC?

the phone-monkey will have targets to meet on the Collection of Personal Information....such as Confirming Employment, Ownership of Prperty etc so that they can build up a picture of the likelihood of getting cash out of you. Its unlikely that they will contact your employer though.

Pepe thank you so much for responding.

Triton were acting on behalf of NW, & I presume AIC as well now. NW have never informed me the debt was passed on, I always though it was still with them.

Thanks for reassuring me about AIC, In between the tears I am researching this forum. Will I be able to request a CCA?

That will depend on the type of Loan.
Natwest are at liberty to use a Collection Agent at any time they wish. If they sell the debt on to a Third party then they must inform you of that action ( not neccesarily before they do it though).

Have a look at/ post on Unenforcability and Templates Thread. Keep reading.

Are also good sources of information.

Dont speak to AIC again, let them write. the phone calls are designed to pressurise you into making a card payment over the phone so that the jerk at the other end makes some commission to buy more kittens to stamp on!

Thank you I am going to take a few deep breathes and calm myself down! Then read....

They have truly terrified me this morning. I am just so petrified they will track me down at work or call me there.

    Appreciate the truly prompt responses.

This tells you what is and isnt fair when it comes to debt Collection.

The start of the Unenforceability and Template Letters thread on this forum has Template Letters for most circumstances.

Do I send a CCA request to NatWest, Triton & AIC?

Send nothing to AIC until they have confirmed their interest/claim in writing.
Send to Triton, as agents for Nat West they are obliged to forward that request to NW.
If they have sold the debt to AIC then they should tell you then.
