ok so have black knight now got all the loancheck cases? i juut want to know

    1. who has my details
    2. how i get them back or get a result from either one
    3. if black knight now have the details of my case, how did they get this without my agreement surely it is against data-protection?

    any advice would be great
I would say that if you signed anything with loancheck there is usually a box to say that you do/don't mind your data being passed on (like with loan agreements) BUT half of the lenders/brokers actually DO pass on your details regardless. Its up to you then to prove that you did not want your details passing to other organisations (its only a tick). I don't know how it would stand with Loancheck though. Also i noted that the introducers were not actually "registered" to handle data BUT they did. How is that right????

TBH ninja, nothing is "right" with any of this.
  • that is very interesting, is there a way to check if certian organisations are registered to handle data online?

Also is there any legislation / governing body that covers companies that undertake cases of financail mis-selling such as loancheck and black knight?

Yes, there is the data protection register. I asked about the introducers and whether they should be registered but seems they don't have to be I think but surely ANYONE handling data should have to be. This is confusing. Maybe there is a law that says that some are exempt or if the main company is registered then the smaller introducers need not be???

As regards the second question, MOJ are the regulators of Claims management Companies but don't know if the ones you mentioned are actually classed as claim management companies.

Just hope you get it all sorted ninja and perhaps we could help on here for you to claim back the PPI. Have you ever tried to claim back the PPI yourself?

Loancheck "sold" their cases to Black Knight who then wrote to all the clients asking them if they wanted Black Knight to continue administering their files.

Loancheck allegedley told Black Knight that they had written to the clients informing them of this fact but .......

Black Knight have now assessed every file where the client agreed and have written to many of the clients with their findings.

If you have a case all you need to do is call them and they will tell you.
Are you actually allowed to "sell" personal data then? Are there not any rules that have to be followed?

This would seem to suggest that Black Knight are carrying on the regulated activities of a regulated claims management company without actually being authorised by the Ministry of Justice to do so? This is a criminal offence under the Compensation Act 2006 unless Black Knight are otherwise exempt from the requirement to be authorised. I am sure that the MOJ would at least be interested to know of your experiences Ninja?
