Hi All
I decided to buy myself a new laptop as I had to keep taking off programmes to put others on... Anyway, I researched the internet and decided to buy a Samson r519 that is fast and a huge 500gb storage space.... of which oyyy was offering the best price (with free windows 7 upgrade)
Anyway, got the laptop last night and started to set it up... and lo and behold... the windows 7 upgrade offer ended on the 31 Jan 2010. I telephoned the customer service and basically they didn't want to know. I said that 'if I had known that I would have to buy the windows 7 upgrade, I would have went elsewhere to buy it... They also said that they wouldn't take the laptop back as I had started using it.... and that they weren't interested that the offer had lapsed.
I am really disappointed... so I will now have to search the net to find the cheapest place to buy a windows 7 upgrade....

do you have a receipt or copy of description of what you actually purchased. If you have and the upgrade is stated then ask for refund as it is not what you contracted to purchased0

Distance selling regulations say you can return it within 7 days regardless. You may lose some money on return carriage etc. though - you'll need to do a bit of research unless somebody knows or can provide a good link showing these consumer rights clearly and simply.

Under the Distance Selling Regulations (DSR), most items can be returned by consumers for a full refund or exchange providing you notify us of your wish to cancel your order and return the item or items within seven days of receiving them. All items must be in an as new condition and in the original packaging. The packaging must not have been damaged or altered by the customer and all items must be unused with all seals/shrink wrap intact.
Any items that were specifically ordered for the customer, or altered or customized to the customer's specification, or pre-recorded media and software of any type, cannot be returned.
These and any other purchases that do not fall within the Distance Selling Regulations normally can not be returned, however if we are able to accept return of these items there may be an admin fee of 25% of the item value (min charge of £25 ex VAT).0 -

That seems to breach the terms of the DSR, I am fairly sure that an item does not have to be in it's original packaging to comply.0

Do you happen to know if all that BS about undamaged packaging and unbroken seals can be enforced? It seems to me that they are saying to comply you need to just turn the box straight around and that seems to me to be unlikely.

Fairly certain that they cannot enforce that, the purpose of the regulations is so that customers can get a hands on feel of the purchased item.
The only exception I believe is software.0 -

I think once windows is 'activated' then you can't return (unless faulty), but happy to be put right.0

Under DSR you cant use the product you can only inspect it this is why we have DSR because it lets consumer see a product like in shops
