at a loss what to do, help!

Hi
Ok so I put in my claim in 2009, I have recieved a letter from my bank stating they say the bank charges are fair and basically will not be giving me my money back. Is there anything I can do given it is worth £2000 to me????????

:(

Any help would be greatly appreciated.

Have you had a read of the latest bank charges reclaiming guide, out yesterday?

    http://www.moneysavingexpert.com/reclaim/bank-charges

Lots of good advice and describes what to do next (except for those who want/need to go to court where advice is promised within the next 2 weeks)

  • Hi

    Thanks for your prompt reply.
The letter i recieved was in December and said they would close the complaint if they had not heard from me in 8 wks.
The other thing is and it sound sad but I am wary to take things further as it stated on the letter that basically I wasnt going to get a penny and I quote 'strongly advise me' to go to the link for the fo if I do decide to take things further?
So what do I do, start from scratch and :(send a new letter?

Only you can decide on whether you wish to continue to expend time & effort in attempting to reclaim bank charges, which may ultimately prove fruitless (unless you have grounds to show hardhip, in which case your claim may have better chances of success)

But whatever you decide, I didn't see anywhere in the article linked to to suggest you again "start from scratch" on the same claim.

  • Hi

    Thanks.

I was going to send the letter with the 140a credit act but the letter from the bank says there is no other legal basis on which the bank charges will or can be challenged?????

If you believe what the bank is saying then give up. Otherwise send the letter.

  • I too have received a letter from HSBC stating the same thing. It also states that their lawyers will be in touch seperately regarding the court action brought against them. Does this mean I am liable for their costs in dealing with my claim? Anyone any idea how much this might be?!

    Thank you.

Where have you made your claim? In the small claims court (or using mcol) like most people? If so, (and assuming there has been no agreement to move the claim to another type of court) you will not be liable for any lawyers costs (and similarly will not be able to reclaim any of your own).

When you sue a company as large as HSBC, it goes directly to their legal team, no matter what the claim or the court.

  • Many thanks for your response. Yes, small claims court so fingers crossed I won't loose any more money due to the delightful banking system.

    All the best.
  • Hi

well I sent my letter off to the bank with the template letter stating the 140a unfair charges and guess what they have basically said unlucky you dont have any grounds to claim your money back, even if I go to the ombudsman I wont get a penny. What do you suggest now?

    Thanks :(
