I had a claim in with Alliance and Leicester for bank charges that was put on hold in 2009. They refused refund after result of court case and then I asked them to reconsider under financial hardship status. Cue another, and final refusal. I'm now trying to complete the FOS form and to my great embarrassment I can't find the original paperwork so I don't know the exact dates or amount (!, yes I know, should have kept hold of it but I tink that I kept the draft of the letter on a work laptop and have been made redundant and didn't print it).
If I contact Alliance and Leicester would they need to send me my original claim letter if I apply under the personal data rules (where you send a cheque for £10) or are they likely to give this over the phone?

Can I ask why you are in financial hardship now but wasn't in 2009?

I was in financial hardship in 2009 but as with most people who put in the standard letter to ask for bank charges back (downloaded from the MSE site) I don't think it mentioned financial hardship, it was purely on the basis that the fees were unfair. When they sent me a letter after the case to say that they were maintaining the fees I read the MSE forums and saw that as I was experiencing financial hardship (redundancy has seen my earnings reduce by almost 50% since Feb 2009 to present and I am currently paying creditors back through Payplan as I was unable to keep up full payments). Anyway, I phoned Alliance and Leicester and they took these details over the phone and advised that the 'team that deals' would review the case. I then recieved a letter today advising that they have reviewed the details and still feel the the charges were lawful and fair and will not refund.0 -

Did you ask on the forums any questions(I haven't taken the time to look)?
Did you see that on the same page as the reclaim bank charges there was the financial hardship guide?
I have been advising on financial hardship for very much over a year on this part of the forum. It does come across as frustrating when financial hardship only comes out after the Supreme Court decision and not before it. HOWEVER, that being said, did you approach the bank at the time you were incurring charges? What was their response?
Did you have priority debt arrears(mortgage/rent, council tax, utilities)?]
Did you approach your debtors and what did they do to help you?

Your issue is not about that but about whether they treated you as a customer in financial hardship fairly at the time the charges were actually at their worst.0 -
Hi All ! Just wanted to get a bit of help / input regarding a claim
i'm making with the HSBC. One thing I noticed when looking into my charges for the last 6 yrs was that I regularly went overdrawn by cash machine withdrawals then charged for it. From when I sent up the account I had small overdraft and for many years when drawing cash out if I put in too much it always refused until I brought it within my available fund, the balance function on cash machines isn't very accurate when you have money going in & out as most of us do. Then suddenly, without notice from the bank they allowed me to go up to £550 over my overdraft ... then charge of course. I am claiming that the fact they changed this was not in my best interest but wondered if anyone know if this could also be fought on the basis that it breached the Terms and conditions of the account as it does specfiy that they have to give notice of at least 30 days of any changes to the term ... or iff any one has any other ideas of how I can strengthen my claim regarding this ? They have now changed it back to not allowing me to go over my overdraft so can clearly switch it "on & off"0 -

At the moment the debt management plan is ok but when my wife goes on maternity leave next month then we drop so much in income that we are in deficite, so will certainly qualify for hardship. thanks for any advice0

Hi I am owed quite alot in bank charges. I am just starting a debt management plan with the cccs. Does anyone know if I can and should still claim back those charges. Was there any credit card charges within that DMP with CCCS? Reclaim them. Furthermore make the bank aware that the amount of money coming in is going down because of your wife's maternity leave and cancel all non essential DD's/SO's0 -
hello, im very new to this bank reclaiming so i could do with some help. its a long ish story.
over the last 4 years i have been on a debt management plan and have struglled to pay it and my other bills and have to invcrease my overdraft to £1900. around 3 years ago i had a period of where i was charged 9 lots of 25 quid for going overdrawn in about 15 months. im struggling and think i fit in the hardship rule and was going to claim for the 225 plus interest, can i calim for the 25 pounds plus i get charged each month. ant advice would be most welcome.
