If and when you get a final response, this is the point you can go to FOS.

The claimant can go to the Financial Ombudsman after 8 weeks from the point they made the initial hardship complaint to the bank.

To say they can only do so ''if and when'' they get a final response from the bank is plainly ludicrous and very poor advice.

The claimant can go to the Financial Ombudsman after 8 weeks from the point they made the initial hardship complaint to the bank.

Or when the bank has issued a final response to the customer (which may be sooner than 8 weeks). Is that not poor advice on your part there?

I said that on the basis the OP may write back and it may get what they are asking for. It doesn't neccessarily mean a final response will be issued hence my wording. But Alpine, I know you like to argue with me over semantics so I'm sure my explanation will fall on deaf ears.

Your wording was that ''If and when you get a final response, this is the point you can go to FOS.'' which is 100% wrong and therefore hardly semantic.

    How is that wrong?

If they send a final response (as it may not require one - normally only sent in deadlock situations)
When they send a final response (as if the OP follows the whole process through they will get a final response at some point)

Fine, I didn't mention 8 weeks. Why? Because the OP didn't ask how long do they have to consider my hardship claim. You seemed to mention 8 weeks in your correction, but fail to mention that the OP can take forward after a final response before the 8 weeks is up. I suggest that if you want to make corrections, you get your facts straight first.

Anyway off to work. If you have any more queries, PM me. ;)
    Best Regards

You said ''if and when.....'' and this is my point.
  • Have written to Santander re my alliance and leicester account requesting £750 of charges plus interest. They have paid me £25 goodwill payment. I noticed the letter didnt say final resolution so I called them and they said I wasnt happy with the £25 (obviously...)

They said they would escalate my case to a stage two whatever the F that means. I nicely pointed out that their jargon was meaningless to me. My case will apparently be reviewed in detail, what on earth they were doing sending me a 6 page letter with a £25 goodwill payment without reviewing my case is beyond me.

Will wait for their response and get back to you.

Bad news it seems for me too, I have been battling with HSBC for many months now for the 4+k they have charged me with 7/8 letters sent, they have now sent a final letter rejecting the claim & advising the will not communicate with me on the issue anymore unless it comes from the FOS or a solicitor. I am no longer in hardship so I have been fighting the legal battle with them so my only option would be court, I know on the threads that there haven't been any sucesses but does anyone know of any cases taken to court at all yet ? Thanks !
  • I got a rejection letter from HSBC like u after writin many times...write to the FOS. We aint in hardship nemore but if u can prove that u were then surely uv got a leg 2 stand on? FOS is creently dealin wiv ours...if that doesn't work THEN go 2 courts but if FOS seys u haven't really got a case then I wouldn't risk ne more money by goin 2 court... thats my plan neway! ...just my opinion :)

  • Hello all.

I followed Martin's tips and used his templates asking MBNA for over £500 back in charges.

They sent me the information free of charge (unlike another bank I've approached since) after I asked for a list of my charges and they later sent me another one after I'd asked for the charges back giving me about £1,200. This cleared my debt and left me in credit with them.

Please, please try and get your charges back.

Cheers to Martin and the MSE team.:j

Hi Happyant, and welcome to MSE :hello:

Your refund appears to relate to credit card charges, rather than bank account charges that this sticky is concerned with :)
