    JSAisnofun reported that they settled out of court having later made a financial hardship claim. I suspect it was the hardship claim, which the bank did acknowlege, that gave rise to the refund ;)

    No one on MSE has reported any success in court to date following the latest MSE guide to reclaiming using legal arguments. Posters have tried, but many give up when the banks give a clear indication that they would strongly defend such claims, and that if the case were to continue, the banks would seek to have the case reallocated away from the small claims/fast track process so that any eventual judgement could be used as a legal precidence (and, also it means the banks can recover all their costs if they go on to get judgement in their favour)

    Please don't take offence with my posting as none is intended.

    I have had issues with regards bank charges; some of which that I have posted on MSE.

    However, I got some good news today.

    I opened a new savings account with Santander a few weeks but I couldn't see my new account on online banking. I complained to the Santander CEO via email at. After two chaser emails, I got a 'gesture of good will gesture' offer from Santander, which I gratefully accepted.

    This is the 2nd gesture of good will offer which I have accepted from Santander. The first one related to a delay with regards opening an account with them last year.

    I'm really surprised with regards the complaints raised against Santander but perhaps I have just been very lucky!

    Touch wood that my luck continues.

    I decided to ask for all my charges for the last year to be refunded, I took nationwides hardship route as we had just had a baby, their first responce was a resounding no. I sent them an email based on Martin's letter creator, within 3 days they had sent me a letter stating that they are going to refund everything I had asked them for. Would not have bothered going this far if it had not been for this website. I encourage anyone who has had the first decline from their back to keep going.

    Definitely agree with last poster, keep going as they just try to shrug you off! My first claim with Nationwide was horrid and went as far as having a court date, but 10 days before we were due to attend they credited the full amount of £2300.00 into my account without even telling me.

    Alliance and Leicester were a little easier and took only two of Martin's ready made letters to get back the full £800.00 just before Christmas last year - so helped alot!

    Am debt free because of this site, and am so very grateful for all the help!
    Total won so far.......................£0 - but hopeful!:)

  • Hi there,

    Just to let you know I have been chasing the Halifax bank for over 2 years. I have used several letters from this site, and on Thursday 30th Sept I got a phone call from the Halifax and they are refunding £586.00 of my Bank charges which i received. Not what I was expecting but Glad I got something from them. I went down the line of financial difficutly. Thanks martin for the great letters, and to everyone else please keep trying.

    I have tried to reclaim my charges back from Lloyds TSB but with no success. I was reclaiming two thousand pounds bank charges and as a goodwill gesture they gave me £750 but I did say to them that I would be pursuing my original claim and was told they had to wait and see what the outcome of the court verdict was but I was welcome to try after that. Anyway since then I have been in touch with TSB even saying I was in financial hardship but they basically said tough so took it to the Omudsman who has since wrote back and also said tough, that TSB are acting in an appropriate manner towards me and were very generous offering me the £750 goodwill gesture and they are now going to close my complaint.

    I presume I am better off giving up now?

    So they are giving you £750 and you are saying that is no success??? :huh:
