Shop took £30 off me after one dayfor sending back faulty guitar is this legal?

A year ago i bought a 12 string guitar in the northern drum centre in Bradford for £300. I took it home and started to play and it was very difficult and the action was terrible. I have been playing in bands 10 years so i know a guitar when i see one.
The very next morning i took it back and the salesman said he could sand down the neck for me or i could have my money back minus a restocking fee of ten percent, thus charging me £30.
I didn't want to risk still having a faulty guitar so i reluctantly accepted the refund minus £30.
Is there any way i can reclaim this money back as i haven't used the shop since in disgust at the way they treated me.
Can anyone help out there?

I think to be honest you should have done something sooner about this rather than a year on!
Also some places do charge a restocking fee for accepting goods back - but if it was faulty they shouldnt have done. Have you tried contacting Consumer Direct ( http://www.consumerdirect.gov.uk ) to see what they say about it though to be honest I think its probably too late now to do anything about itWeight Loss - 102lb0 -
I bought Northern Drum Centre in Bradford in Sep 2005 and have just stumbled across this forum and frankly, I'm shocked! This shop has been established 20 years and has an excellent reputation nationwide. This does not happen if you rip people off.
All I can say is that we make a point of physically checking and setting up every guitar new or used that we sell..it is one of the plus points of buying an instrument from a specialist. If the person who posted the original complaint reckons to have bought a 'faulty' instrument from ourselves then he/she wouldn't know a guitar if he/she fell over one as we wouldn't put one on display in the first place never mind let it leave the premises.
It would indeed be illegal to not give a refund if a product were faulty.. I can only imagine that the salesman was offering to placate the customer by sanding the neck if he thought that would solve whatever the customer was having particular problems with...hence the restocking fee as the instrument in his opinion would not be faulty.
It just goes to show that you can't please everyone all the time and on behalf of Northern Drum Centre and its staff, I apologise for the unfortunate situation that has transpired and the inconvenience caused.0 -

The first post is over 6 months old and the poster never returned and only ever posted three times so I guess he wasn't to worried about the £30.0

The new owner wasn't the owner when the customer was 'ripped off'. Why should he give him back his £30? I've used the drum centre in Bradford a few times and they've always been an honest shop.0

and if the other person was a 10yr guitar player wouldnt they have noticed the bad action in the 1st place and not have bought it.
could just come down to having a different neck shape than they are used toSmile and be happy, things can usually get worse!0 -
I would have thought anyone who had been playing guitar for 10 years would have noticed that they didn't like the action when trying it out in the shop. This doesn't mean the guitar was faulty, just that the set-up was not to the poster's taste!
I would also expect them to be able to adjust the action themselves, or have a luthier or other guitar specialist who can do this for them. Either way, a year on is a little too long to wait for compensation if something has bothered you that much...0 -
I agree he should have done something at the time - but so called reputable shops are not above selling faulty goods if you ask me. My husband once went to Forsythes on Deansgate, Manchester - massive, long established music shop - with the intention of spending £500 on a banjo (yes, I know....). He tried one (quality brand) but the neck was warped - the manager said, "Oh, that shouldn't be out on display... we'll sort it out, come back next week." Went back a few weeks later... same banjo, same warp, still out for sale. Never been there since.0
