Mobile Phones in Bankruptcy

  • Richestorags: All three phones in my name and paying for them myself. It's my only excess, my debt is historic debt.
  • not 100% sure theres something about being bankrupt and a £500 limit if i remember what im trying to mean here i think if your 3 mobile phone contracts add up to more than £500 per year i think you might have to say something
    ie
    one phone £60 pm
    2nd phone £20 pm
    3rd phone £20 pm
    total cost £100 pm x 12 months 1200 quid
  • Are they all from the same provider? If not, maybe you could throw 2 in your BR and just keep the one?
  • What about if they are not in debt..can I still add them to the bankruptcy and will they be added if requested? Shall I not sell the mobiles just in case?
  • I can't see you being allowed more than one in your BR and the other 2 would probably have to come from your surplus.

You are allowed a £99 surplus once all your other reasonable expenses have been taken into account, this isn't alot to be paying for extra mobile phones out of and you have to remember once BR you have nothing to fall back on.

Have you spoken to one of the debt charities?
  • Why are they working out a surplus? £99 to do what with?
Sorry, I really am, your going to need to write like I am a 3 year old so I understand...I haven't even seen the bankruptcy forms yet
  • The OR will look at your essential expenses, gas, elec, groceries, etc and decide whether they are reasonable or not for your size of family. After these are taken into account you are then allowed a £99 surplus (if you have that much left after the other expenses), if you have more than this a % is taken from you by way of an IPA.

Anything not allowed in normal expenses must be paid for out of your surplus, such as cable TV, internet (unless needed for work/edu), your mobile phones etc.

You really need to speak to one of the debt charities, like national debtline.
