    no, it is not apprentice rates. I have just rung direct.gov. and they have told me that they are breaking the law. It is an hourly rate, with no commission-based earnings, and seeing as im over 21 years old they have no excuse

    As for apprentice rates, where i used to work, we had a 17 year old and he was on £7.25 p/h!!!!

    Wrong. Paid holidays are paid at the same rate as worked hours and all hours have to be at least at the NMW.

    This employer is clearly attempting to break the law, if he has not already done so.

    First of all you can report them to the Pay and Work Rights Helpline on 0800 917 2368

    You should contact the paper that carried the advert. Inform the ads. dept. about the employer, as well as writing a 'letter to the editor'.

    Finally, your local Trades Council (if you have one) would be very interested to hear about an employer like this operating in their area.

    Well done for not accepting such an insult. :TGood luck finding a job with a real employer.

    £468 per year? Not an inconsiderate amount. And it's the law for a reason, it's there to protect employees. If 5.60's ok , why not 5.50? It's only 10p less 5.40? 5.30? You get where I'm going with this.

    Salaried staff do, "time workers" (ie hourly rate) don't
    "Time workers don’t need to be paid the NMW for hours spent:...
    .. away from work on rest breaks, holidays, sick leave or maternity leave"

    If you had taken the time to read both lizzies and my posts you will have noticed that:
    A. I am not making a huff. I am merely pointing out that a law has been broken,or attempted to be broken
    B. I didnt take the job! so therefore how can i be "willing" to work for less than NMW>?

    I did actually call the pay and works earlier the sevening and they indeed said they were breaking the law. I will also think about contacting the local paper, but it was just the job that was edvertised, and not the hourly rate.

    Well - as no-one's answered my question - may I suggest you ARE (or would be!) paid minimum wage, but those 'paid' lunch times are in reality unpaid?

    Taking a guess - 45hpw x £5.60 = £252 gross

    42.5hpw x £5.80 = £246.50 gross

    So if you're getting £252 pw and the lunch times are unpaid you'd be on £5.92ph.
