Equity redstar nightmare.

In a nutshell named driver on my traders had an at fault incident.

Informed ERS filled out form admitted liability. Other side playing fair and only claiming for damage caused by my OH. (there were several vehicles involved)

Due to my insurer dragging their feet court papers issued. Rang ERS, no problem, send them in, we will pay, it wont go to court. I done this, they confirmed receipt

Today the post came. CCJ for my OH by default:mad:

Livid to say the least.

Just going to ring them now

    I believe it is possible to have the CCJ overturned and that in addition it does not affect your credit record providing it's paid within a certain amount of days.

    You need to get on to a superviser at ERS and ask them to sort this out, so you have a broker if so they should be sorting this out for you.

    The ERS Underwriters (Who are very knowledgeable and helpful) must dispair when a mistake like this happens as it ruins their carefully calculated costings

    I meant in the post today there was a CCJ for my OH, as in it's her post, but yes I meant aginst her, lol.

    Dacouch I tried to speak to a supervisor but they were all on lunch or not available. I was advised to fax the judgement over to them and they would pay for it. When I asked them to confirm this would have the judgement removed the girl said, "yes it will show as satisfied"

    I then informed her I didn't want it showing at all and was not prepared for my OH credit file to be marked due to their incompitence. She went to answer but the line went dead, I think the call was being supervised. Then she came back on saying, "right, send it over, we can get it removed in a certain amount of time but we have to pay a fee"

    I have sent the fax over and intend to email them and phone them tomorrow too.

    Absolute nightmare

    Choicequote are rubbish. They're owned by Groupama, hence why they aren't bothered about customers who are insured through them but aren't with Groupama.

    I would suggest dealing with it along the following lines.

    Ring again about the CCJ, be polite but advise them of the problems this can potentially cause. Try and ask the following (Politely) "Would you be happy if you paid your insurance and gave plenty of notice to your Insurers about a county court case and it was ignored and you subsequently received a CCJ"? They will have to answer no and this gets them feeling guilty. You then say "We have to get this sorted out so there is no affect on our credit rating, so how can you help me to get this sorted out"?

    She should then start wanting to help you out personally, ask if you can fax the documents for her personal attention and when she agrees, advise her you will ring her when you have sent the fax for her to go and collect it. Also advise her you will ring her the next afternoon to find out what she has done. Make sure you ring the next day as you agreed and see if they have done anything, if not advise her you will ring her the next day and keep doing this. They will want to get it sorted to help you out and to get you off their back.

    Try and keep as polite as possible but remain firm, if you start shouting you will get their backs up, you are far more likely to get it sorted by being polite and keep speaking to the same person

    Ahhhh a French Insurer, may favourites (Not), did they give a gallic shrug when they said they could not help and gave you the telephone number

    delat with them by phone, they really dont have a clue. These are the same ones who didnt take a car off cover if you remember from last week which was then in a crash,, luckily the buyer had insurance so the claim is being redirected

    Hi ...

    Really sorry to hear how you are being dealt with.

    I know this might be off at a tangent to getting the issue itself resolved, but I hope this may give you information which you can use in your calls to the Insurer as it affects any credit file. If they get their finger out - it hopefully won't affect you.

    Extract:

    If you accept you owe all the money, you'll have a CCJ made against you. But if you pay the money within one month of the date of the CCJ, the order won't appear on your credit file.

    Thing is I've had that many reassurances from them that they have broken Im VERY worried about them handling this properly
